A.
These general regulations apply to the parks, trails, parking lots,
parking decks, riparian land, and other property described in this
article, unless a more specific section of this article applies.
B.
Prohibited activities. It shall be unlawful, on the land described in Subsection A, to:
(1)
Possess or consume any alcoholic beverage, except as permitted in
writing by the parks and recreation department.
(2)
Go on or remain upon the property outside of posted hours, or between
10:00 p.m. and 5:00 a.m. if no hours have been posted.
(3)
Trespass on any portion of the property posted with appropriate signs.
(4)
Use or park a motor vehicle other than in designated areas.
(5)
Possess any glass container in an area posted with appropriate signs.
(6)
Set or maintain a fire, except in cooking grills.
(7)
Camp, except as permitted in writing by the parks and recreation
department, or use the property for living accommodations.
(8)
Cut, clear, damage, or destroy any tree or other natural vegetation.
(9)
Throw or deposit litter on the property except in designated receptacles.
(10)
Deface any building, table, bench, pavement, sign, or other
public property.
(11)
Pollute the streams, ponds, rivers, wetlands, or other water
resources located on or adjacent to the property.
(12)
Disobey commands by law enforcement or City employees to obey
posted rules.
C.
Exemptions. This article does not restrict the rights of the Commonwealth
or any public utility to go and remain upon public property to install,
repair, or maintain facilities they own or operate. This article does
not restrict rights granted by recorded easement. This article does
not apply to law enforcement and City employees acting in the course
of their duties.
D.
Penalties. Violation of any provision of this article is a Class
4 misdemeanor with a maximum $250 pre-payable fine, unless a provision
specifies a different penalty for a particular offense.

Old Mill Park and Riverside Drive Park, from the corner of Fall Hill
Avenue and Normandy Avenue to the former VEPCO power plant, between
the Rappahannock River and Caroline Street/Riverside Drive. Parcels

(4)
Riverfront Park, between Sophia Street and the Rappahannock River,
between Wolfe and Hanover Streets.
(5)
Maury Park, fronting on Kenmore Avenue between William and Hanover
Streets, surrounded by a chain-link fence. A portion of Parcel 7779-93-8968.
(6)
W.L. Harris Playground, between White, Tyler, Dixon, and Glover Streets.
(7)
Powhatan Park, located north of the intersection of Cowan Boulevard
and Powhatan Street, on the property with the water tower and playground.

(8)
Alum Springs Park, located generally between the Alum Springs Road
right-of-way, U.S. Route 1 Bypass and the Greenbrier Apartments. Parcel
7778-49-9859.
(9)
Snowden Playground on Fall Hill Avenue between Curtis Estates and
Crestview Apartments, including the baseball fields, basketball courts,
and playground. Parcel 7779-09-1114.
(10)
Cossey Park, bounded by Mary Ball Street, Kenmore Avenue, and
Littlepage Street. Parcel 7779-76-9695.
(11)
Memorial Recreation Park, including the tennis courts, bounded
by Kenmore Avenue and Mary Ball Street.
(12)
Cobblestone Park, located south of Cobblestone Boulevard and
Cobblestone Lane. Parcel 7789-01-3169.
(13)
City Dock, the public park and boat ramp located between the
Rappahannock River and Sophia Street, between Princess Elizabeth and
Dixon Street. Parcels 7789-32-1981, 7789-32-2767, and 7789-32-3567.
B.
Specific prohibitions. It shall be unlawful, on the property described in Subsection A, to:
(1)
Deposit any trash (as defined in § 17-1) not generated
in a park in a park refuse container.
(2)
Fail to leave a reserved pavilion, picnic facility, or sports field
in favor of the person with a parks department reservation, after
being requested to do so.
(3)
Conduct any business requiring a City business license, without advance
written permission from the parks and recreation department.

A.
Descriptions.
(1)
Canal path and Rappahannock River Heritage Trail. The paved five-kilometer
path following the course of the canal, then along Caroline Street,
Riverside Drive, and Fall Hill Avenue.
(2)
Virginia Central Railway Trail. The paved path in the former VCR
right-of-way, from the eastern end of the Cobblestone development
off Lafayette Boulevard out Lafayette Boulevard and across the Blue
and Gray Parkway, then through Alum Springs Park and across U.S. Route
1 to a point near the Idlewild neighborhood, just east of 1-95.
(3)
Smith Run Trail. The two-kilometer path along Smith Run from Hugh
Mercer Elementary School to Cowan Boulevard, with a branch to the
Great Oaks subdivision.
(4)
Embrey Dam/Rappahannock Canal Trail. The dirt trail beginning at
the intersection of Fall Hill Avenue and the Rappahannock Canal and
running along the Rappahannock River to the City limits.

A.
Descriptions. The City parking deck is located on the corner of Sophia
and Wolfe Streets. All municipal parking lots are also covered by
this section.
B.
Specific prohibitions. It shall be unlawful, on the property described in Subsection A, to: remain on the property unless parking or driving a motor vehicle. Anyone on the property for longer than 15 minutes is presumed to be in violation of this section.
C.
Exemptions. Possession, but not consumption, of alcoholic beverages
is permitted.
D.
Signs. A sign stating "PUBLIC PARKING. NO TRESPASSING EXCEPT FOR
PARKING MOTOR VEHICLES" or containing similar language shall be posted
conspicuously on every property covered by this section.

A.
The City dog park is the fenced area set aside at Cossey Park.
B.
Specific rules and prohibitions. It shall be unlawful, on the property described in Subsection A to:
(2)
Enter the park with a dog that is not wearing a valid, current City
of Fredericksburg dog license tag fastened securely to a collar.
(3)
Enter the park with a dog that has been banned from the dog park,
for the duration of the ban.
(4)
Fail to clean up after a dog as required by City Code § 14-52.
(5)
Violate any additional rules established by the City Manager and
posted at the park.
C.
Exemptions. The owner or custodian of a dog may permit the dog to
run off leash within the dog park, so long as the owner or custodian
is present and re-leashes the dog immediately if the dog is involved
in an incident.
D.
Penalty. The penalty for a violation of this section is a $25 fine, pre-payable to the Fredericksburg General District Court, except that violation of § 66-256B(1) is a Class 1 misdemeanor. In addition, the City Manager may ban a person and his dog from the park for a serious violation or repeated violations of this section.

A.
Motts Run Reservoir consists of roughly 880 acres located off State
Route 688 in Spotsylvania County.
B.
Specific prohibitions. It shall be unlawful, on the property described in Subsection A, to:
(1)
Use the property for commercial purposes without advance written
permission from the parks and recreation department.
(2)
Use a boat operated by diesel or gasoline engine.
(3)
Swim, bathe, or ice skate.
(4)
Dig, bore, or otherwise erode or undermine the integrity of the banks
of the property.
(5)
Discharge a firearm, except for the purpose of licensed hunting.
Hunting is prohibited within areas marked as safety zones.
(6)
Trap animals.

A.
Description. The City's riparian and watershed property consists of all City-owned land along the banks of the Rappahannock River, the Rapidan River, Deep Run, and all other tributaries of those waters in the City and Spotsylvania, Stafford, Orange, Fauquier, and Culpeper counties, not listed in §§ 66-252 through 66-256. This property, consisting of roughly 4,800 acres, is described in the deed dated March 19, 1969, from the Virginia Electric and Power Company to the City, recorded at Deed Book 137, page 360, of the land records of the Fredericksburg Circuit Court Clerk. It also includes the island containing 4.08 acres of land, more or less, described in the deed dated July 31, 2009, from the Fredericksburg Stafford Park Authority to the City, recorded as Instrument No. 090001856 in the land records of the Fredericksburg Circuit Court Clerk, commonly known as "Ficklen Island."
B.
Specific prohibitions. It shall be unlawful, on the property described in Subsection A, to:
(1)
Dump, bury, or burn garbage.
(2)
Discharge a firearm, except for the purpose of licensed hunting.
Hunting is prohibited within areas marked as safety zones and on Ficklen
Island.
(3)
Trap animals.
(4)
Disturb land in a way likely to result in soil erosion or sedimentation.
(5)
Dispose of human excrement by any means other than burial at least
12 inches below the ground surface and at least 100 feet from any
river, stream, or body of water on or adjacent to the property.
(6)
Disturb, deface, injure, or move any structure, building, facility,
or artifact, including any portion of a lock, dam, or canal.
C.
Exemptions.
(1)
No person is guilty of a violation of this section if he has the
prior written permission of the City Manager to engage in the prohibited
activity, or if he has a recorded property right to engage in that
activity.
(2)
Camping is permitted unless prohibited by posted sign or another
law or ordinance.
(3)
Campfires used for cooking, heating, or lighting, and attended at
all times, are permitted except on Ficklen Island.

A.
Description. The triangular parcel of City-owned land located in
front of the former Maury School and bounded on two sides by George
Street and on one side by Barton Street, but not including the monument
to Confederate Veterans, which will be relocated off-site.
B.
The property described in Subsection A is designated as the Fredericksburg Area War Memorial, which shall be a memorial to the members of our United States Armed Uniformed Military Services from the City of Fredericksburg and the Counties of Caroline, Orange, King George, Spotsylvania, and Stafford, who were killed in action or died during the service of our nation in foreign military or related operations during the 20th and 21st centuries.
C.
Definitions.
(1)
The term "demonstrations" includes demonstrations, picketing, speechmaking,
marching, holding vigils or religious services and all other like
forms of conduct which involve the communication or expression of
views or grievances, engaged in by one or more persons, the conduct
of which has the effect, intent or propensity to draw a crowd or onlookers.
This term does not include use by visitors which does not have an
intent or propensity to attract a crowd or onlookers.
(2)
The term "special events" includes sports events, pageants, celebrations,
historical reenactments, regattas, entertainments, exhibitions, parades,
fairs, festivals and similar events, which are not demonstrations
under Subsection A(1) of this section, and which are engaged in by
one or more persons, the conduct of which has the effect, intent or
propensity to draw a crowd or onlookers. This term does not include
use by visitors which does not have an intent or propensity to attract
a crowd or onlookers.
(3)
The term "official commemoration events" means the official ceremonies
organized by the City of Fredericksburg to commemorate Memorial Day
and Veterans Day and to honor those whose names are added to the War
Memorial.
D.
Prohibited activities. It shall be unlawful, at the Fredericksburg
Area War Memorial, to:
(1)
Disturb or interfere with the Fredericksburg Area War Memorial, including
but not limited to removal of, damaging or defacing the memorial,
and posting signs or banners thereon.
(2)
Picnic, camp, skateboard, play sports, play amplified music (except
as part of an official event).
(3)
Perform demonstrations or hold special events. This prohibition shall not extend to official commemoration events as defined in Subsection C.
(4)
Solicit alms or contributions, campaign for election to any public
office, collect private debts, engage in any commercial soliciting
or vending, display or distribute any commercial advertising, or post
signs or banners of any kind.
