Any person, bank, lending institution, or legal entity who or
which has an interest in real property, where said real property is
exempt from taxation, or a portion thereof, under New York State law
or under this chapter, and where said real property is no longer eligible
for said tax exemption, must notify the Brookhaven Town Sole Assessor
within 30 days of the date of ineligibility for said exemption.
Notification shall be made in writing and filed in the office
of the Brookhaven Town Sole Assessor.
This article shall become effective immediately upon filing
with the Secretary of State.
Any violation of this article shall be punishable by a fine
of not more than $5,000.
If any clause, sentence, paragraph, subdivision, section or
part of this article or the application thereof to any person, individual,
corporation, firm, partnership, entity or circumstance shall be adjudged
by any court of competent jurisdiction to be invalid or unconstitutional,
such order or judgment shall not affect, impair or invalidate the
remainder thereof, but shall be confined in its operation to the clause,
sentence, paragraph, subdivision, section or part of this article,
or in its application to the person, individual, corporation, firm,
partnership, entity or circumstance, directly involved in the controversy
in which such order or judgment shall be rendered.
