A. The
activation of an alarm system whereby the Police are summoned to a
location and no criminal activity in fact occurred or was attempted.
The following shall not be considered false alarms:
1. An alarm caused by severe weather conditions or electric power failure;
2. An alarm caused by or resulting from damage, testing or repair of
telephone equipment or lines by the telephone company, provided that
such incidents are promptly reported to the telephone company;
3. An alarm caused by an attempted and unauthorized or illegal entry
of which there is visible evidence;
4. An alarm caused by vandalism or destruction of property of which
there is visible evidence;
5. An alarm intentionally caused by the resident or occupant acting
under a reasonable belief that a need exists to call in reference
to an emergency.
B. Persons,
individual, firm, partnership, association, corporation, company or
organization of any kind:
1. Upon receipt of the first (1st) false alarm within a month (thirty
(30) day period), notice shall be issued by the Police Department
to the subscriber. One (1) false alarm is permitted in a thirty (30)
day period.
2. The Police Department shall constitute a violation of this Article
and will result in a summons to appear in Municipal Court. Failure
to appear in court will result in a warrant to be issued for the person's
arrest.
3. The fee shall be ten dollars ($10.00) for the first (1st) such alarm
in excess of the permitted number of false alarms and twenty-five
dollars ($25.00) for each additional and subsequent alarm in excess
of the permitted number up to and including five (5) false alarms
in a thirty (30) day period. The fee shall be fifty dollars ($50.00)
for any false alarms in excess of six (6) in a thirty (30) day period.
