A. 
Whenever it appears that a culvert must be installed, replaced, or repaired, the responsible party shall first apply to the Town Board for a permit.
B. 
The Town Board may place such restrictions on a permit as it deems necessary for the safety of its residents, for the prevention of water damage, and for the prevention of drainage problems.
C. 
In the event a culvert is repaired or replaced, the applicant shall be responsible for restoring the area to its previous condition.
D. 
In the event a culvert is newly installed, the applicant shall be responsible for restoring the area to the proper grade, for the condition of any ditch which may be affected, and for compliance with any other applicable law, ordinance, regulation or condition of the permit.
E. 
Only metal culverts shall be used in the Town.
Minimum culvert size must be 18 inches by 24 feet, with end walls.
A. 
If any culvert is installed, replaced, or repaired in violation of the provisions of this chapter, the Town may restore the area to a condition which complies with this chapter and recover the cost from the responsible party.
B. 
The penalty for violation of any provision of this chapter shall be a forfeiture of not less than $75 nor more than $1,000 together with the actual costs of prosecution, including attorney fees. Each day of continuing violation shall constitute a separate offense.[1]
