In accordance with C.G.S. Chapter 14, Freedom of Information
Act, all information maintained by the MWCPA relating to the operation
and maintenance of the public sewer system shall be available to the
public without restriction.
Public access to records will only be restricted when the user
specifically requests in writing to the MWPCA for exclusion of its
records and is able to demonstrate the statutory authority for the
granting of such request, or other legal or satisfactory reason that
the release of such information would divulge information, processes
or methods of production entitled to protection as trade secrets under
applicable state and federal law. Any such request must be asserted
at the time of submission of information or data.
If the MWPCA finds that a user can demonstrate certain information
made available to the MWPCA shall be held confidential, the portions
of information received that might disclose trade secrets or secret
processes shall be held in a file denoting that the information in
that file is not to be made available for public inspection. However,
any confidential information shall be made available immediately upon
request of governmental agencies for uses related to the NPDES program,
pretreatment program, and in enforcement proceedings involving the
person furnishing the report or the property owner. Wastewater constituents
and characteristics and other effluent data as defined by 40 CFR 2.302
will not be recognized as confidential information and will be available
to the public without restriction.
