The City has adopted the provisions of MGL c. 40 § 22F, pursuant to City Council Order 2004-193, permitting that any municipal board or officer empowered to issue a license, permit, certificate, or to render a service or perform work for a person or class of persons, may, from time to time, fix reasonable fees for all such licenses, permits, or certificates issued pursuant to statutes or regulations wherein the entire proceeds of the fee remain with such issuing city or town, and may fix reasonable charges to be paid for any services rendered or work performed by the city or town or any department. Such fees shall be subject to the approval of the City Council.
A. 
Any ordinance of the City of Beverly or any rule or regulation of its officers, boards or departments, the violation of which is subject to a specific penalty, may, in the discretion of the City official who is the appropriate enforcing person, be enforced by the method provided in MGL c. 40, § 21D. The noncriminal fine for each such violation, if not otherwise specified, shall be $25.
B. 
"Enforcing person," as used in this section, shall mean any City police officer of the City of Beverly, with respect to any offense, and the Director of Municipal Inspections and his designees, duly authorized designees of the Conservation Commission, duly authorized designees of the Board of Health, the Director of Engineering, Commissioner of Public Services, Public Works, or his designees, the Animal Inspector, and such other officials as the Mayor may from time to time designate, each with respect to violation of ordinances and rules and regulations within their respective jurisdictions. If more than one official has jurisdiction in a given case, any such official may be an enforcing person with respect thereto. Police officers shall in all cases be considered enforcing persons for the purpose of this section.
C. 
Unless otherwise provided, each day a violation continues shall constitute a separate and repeat violation.
