Under authority of the State laws of Missouri Sections 90.500
to 90.570, RSMo., there be and is hereby created a Park and Recreation
Board in the City of Excelsior Springs, Missouri, the Directors of
which shall be appointed by the Mayor, subject to the consent of the
City Council, and shall consist of nine (9) members and shall be chosen
from the citizens at large with reference to their fitness for such
office, and no member of the municipal government shall be a member
of the Board. The Mayor, subject to the consent of the City Council,
may appoint a representative of the Excelsior Springs School District
to serve as a non-voting Board liaison.

A. Such
members shall hold their respective office from June 1 following their
appointment. They shall be appointed for a term of three (3) years,
except that those appointed at the first meeting shall cast lots,
for their respective terms, three (3) Directors to serve three (3)
years, three (3) Directors to serve two (2) years, and three (3) Directors
to serve one (1) year. All initial terms of office shall be retroactive
to June 1, 1973. Annually and thereafter, on or before the first (1st)
meeting in June, the Mayor shall, by and with the consent of the Council,
appoint three (3) Directors, who shall hold office for three (3) years.
B. The
Mayor may, by and with the consent of the Council remove any members
of the Park and Recreation Board for misconduct or neglect of duty.
C. Vacancies
occasioned by removal, resignation or otherwise, shall be reported
to the Council, and shall be filed in like manner as original appointments,
except that the term of office is restricted to the unexpired term
of office. No Director of the Board shall receive compensation as
such.

The Park and Recreation Board shall, immediately after the appointment
of Directors, meet and organize by the election of one (1) member
as president, and by the election of such other officers as they may
deem necessary. The Board shall make and adopt such by-laws, rules
and regulations for its own guidance and proceedings as may be expedient,
not inconsistent with this Article and Sections 90.500 to 90.570,
RSMo.

A. The
Park and Recreation Board shall:

1. Survey and make plans for the development and maintenance of facilities
and activities for an adequate municipal park and recreational system.
2. The Board shall have exclusive control of the expenditures of all
money collected to the credit of the Park and Recreation Funds, for
the supervision, improvement, care, acquisition and custody of the
parks and recreational programs.
3. All monies received for such activities shall be deposited in the
official City depository to the credit of the Park and Recreation
Fund and shall be kept separate from all other monies and accounts
of the City of Excelsior Springs, Missouri, and be drawn upon by the
proper officers of the City of Excelsior Springs, Missouri, upon the
properly authenticated vouchers of the Park and Recreation Board.
4. The Park and Recreation Board shall have power to appoint a suitable
person to take charge of said park and recreational programs and necessary
assistants, and to fix their compensation. The Board shall also have
power to remove such appointees for misconduct or neglect of duty,
and shall, in general carry out the spirit and intent of Sections
90.500 to 90.570, RSMo., in establishing and maintaining a public
park and recreational program.
5. Pursuant to Section
150.090, the following rules and regulations established by the Park Board of the City of Excelsior Springs, Missouri, are declared and ordained to be a part of the Code of Ordinances of the City of Excelsior Springs, Missouri, and any wilful violation thereof will be upon conviction deemed to be an ordinance violation. These rules shall apply to not only park lands but also to any premises under the administrative management or control and custody of the Park Board.
B. Miscellaneous Park Rules.
1. Motor vehicles shall be driven only on designated roadways.
2. All park premises shall be closed to the public from 10:00 P.M. until
6:00 A.M. of the next day with the exception of East Valley Park.
East Valley Park may be used on a twenty-four (24) hour basis with
permission of the Parks and Recreation Department.
3. There shall be no littering.
4. No motor vehicle shall be driven at a speed in excess of ten (10)
miles per hour.
5. There shall be no destruction or vandalism of facilities or premises. Vandalism is willfully injuring, damaging, mutilating, defacing, removing, destroying or impairing the use of any property without the consent of the owner. Vandalism in the park is considered an ordinance violation and will be prosecuted under Section
230.345 of this Code.
6. Any activity or conduct that is or could be injurious or disturbing
to residents surrounding the park area is hereby prohibited.
7. Firearms and fireworks are not allowed on Parks and Recreation operated
areas except when permission is gained from the Department.

These rules shall be posted at the main entrance to said park
premises, and for the purposes the main entrance is the one from the
most traveled roadway.

The said Board of Directors shall make, on or before the second
Monday in June, an annual report to the City Council stating the condition
of their trust on the first (1st) day of May of that year, the various
sums of money received from the Park Fund and other sources, and how
much monies have been expended and for what purposes, with such other
statistics, information and suggestions as they may deem of general
interest. All such portions of such report as relate to the receipt
and expenditure of money shall be verified by affidavit.

The Park and Recreation Board shall be held as special trustees
for all donations of money, personal property or real estate for the
benefit of such park, whenever such donations are accepted according
to the terms of the deed, gift, devise or bequest of such property.
