[Code 1961 §2-34; CC 1976 §2-137]
A. It
shall be the duty of the City Clerk to attend the meetings of the
City Council; to keep regular minutes of their proceedings and to
record the same and all ordinances which may become laws and all resolutions
passed by the Council in the journal.
B. He/she
shall have the custody of the City Seal, the original rolls of ordinances
and resolutions passed by the City Council, the public records of
the City, and all such other papers, records and documents as may
be entrusted to his/her care, and the same he/she shall safely and
properly keep.
C. He/she
shall record the official bonds of all City Officers and all other
bonds executed to the City and filed in his/her office, in a book
kept for that purpose.
D. He/she
shall affix the City Seal to and countersign all such public instruments,
documents and papers as are required by law or ordinance to be attested
with the Seal of the City.
E. He/she
shall certify under his/her hand and the Seal of the City all such
documents, copies or papers in his/her office as may be required for
the use of any City Officer or private citizen.
F. He/she
shall furnish to the City Attorney or City Council any record, document
or paper in his/her office, which either may be called for or be used
in any court; but for the same he/she shall take and file a receipt.
G. He/she
shall, whenever required, furnish the Mayor, City Council or any committee
of the Council copies or abstracts of any books, accounts, records,
vouchers or documents in his/her office, or any information relating
to the business of the City or of his/her office, and he/she shall
at all times permit the Mayor, any member of the City Council or any
interested City Officer or other person, to examine any books, papers
or documents in his/her office.

The City Clerk shall prepare, seal with the City Seal and countersign
all commissions and other official documents which the Mayor is required
to issue and keep a register thereof, in which the substance thereof
shall be noted.

The City Clerk shall be General Accountant of the City. He/she
shall examine, audit and adjust all accounts, claims and demands in
favor of or against the City, and shall after such examination certify
the amount of balance due from the City on each account with invoice
and voucher therefor to the City Council or authorized committee thereof.
He/she shall keep the account of the City in proper books therefor,
in which the City shall be represented by the term "City revenue" in which shall be charged all monies coming into the City Treasury
from whatever source derived, which shall be specified. He/she shall
also keep in proper books the accounts between the City and Director
of Finance, charging the latter with all monies received into the
Treasury and crediting him/her with all moneys paid out in accordance
with the law, in each case specifying the source from which such money
was received and on what account paid out. He/she shall keep in proper
books therefor the accounts between the City and all officers or persons
who may have entrusted to them the collection of any money for the
City, charging each with the amount which may be in his/her hands
for collection and crediting him/her with all payments into the City
Treasury. He/she shall keep in proper books therefor a statement of
the condition of the City revenue in which every fund (which by law
or ordinance is made a separate fund) shall be credited with all receipts
into the Treasury on account thereof, and shall be charged with all
appropriation thereof and warrants drawn thereon.

The City Clerk shall keep a register of all vouchers of approved
bills and of warrants drawn on the Treasury wherein shall be stated
the date, number and amount thereof, and to whom and out of what fund
payable. He/she shall also keep an account of all debts due to or
by the City.

The City Clerk shall procure all stationery, books and other
articles necessary for his/her own office and that of the other City
Officers, and for the City Council, and shall furnish all City Officers
with such books as are required to be used or kept by them, of all
of which he/she shall keep an accurate account, taking receipts from
all officers to whom he/she shall deliver such supplies. He/she shall
also pay the postage on, or the necessary expenses of any official
documents received or sent by him/her, or any other City Officer,
and for all expenses incurred under the provisions of this Section
he/she shall draw a warrant on the Director of Finance, payable out
of the appropriation for such purposes.

The City Clerk shall draw and countersign warrants on the Director
of Finance for any moneys found to be due and owing by the City, and
for which there is an appropriation specifying therein the fund or
appropriation out of which such warrants shall be paid, but no such
warrant shall be issued unless there is actually in the Treasury money
sufficient to pay the same.

The City Clerk shall not draw or issue warrants for the payment of any accounts mentioned in or arising under the provisions of Sections
115.160 and
115.170 until such accounts have been approved by the City Council, as evidenced by its resolution to that effect, and no warrant for the payment of money drawn by the City Clerk shall be paid by the Director of Finance unless the same is signed by the Mayor.

The City Clerk shall at the first (1st) regular meeting of the
City Council in April of each year render his/her account with the
proper vouchers, to the City Council, who shall settle and adjust
the same.

The City Clerk shall have the power to administer oaths or affirmations
to parties or witnesses in any case in which he/she may deem it necessary
in the course of any examination of accounts or claims presented by
him/her to be audited; and all oaths required by law, including oaths
of office, may be administered by the City Clerk, except oaths in
the Municipal Court, which shall be administered by the Municipal
Judge.

The City Clerk shall in all City elections perform all the duties
specified in the general election law of the State, and he/she shall
also perform all such duties as may be from time to time required
of him/her by law or ordinance.

The City Clerk shall issue special tax bills as directed by
ordinance. The City Clerk shall keep a record of all special tax bills
issued in a special book provided for that purpose, which record shall
show the date and amount of each tax bill, the rate of interest it
bears, and a description of the land against which it was issued,
the name of the party to whom it was issued and the improvement or
other purpose for which the cost was incurred. The City Clerk shall
record the satisfaction of any tax bill to him/her marked paid. A
tax bill when satisfied shall be considered canceled.

A. The
City Clerk shall head the department of personnel and be responsible
for the conduct of all its affairs. The City Clerk shall have power,
and it shall be his/her duty:
1. To establish and maintain a roster of all office employees in all
the offices and departments of the City. The term "office
employee" shall include secretaries, stenographers, typists,
clerks, tax clerks, bookkeepers, accountants, and all other clerical
employees in the various departments.
2. To prepare and recommend to the Mayor and City Council a compensation
plan.
3. To allocate each position to its appropriate class in a classification
plan, and to reallocate positions as conditions warrant from class
to class.
4. To prepare and maintain appropriate definitions of classes and grades
in a classification plan, and amend them from time to time as he/she
may deem such action to be warranted.
5. To hold examinations, pass upon the qualifications of applicants,
and establish lists as needed for filling vacancies.
6. To devise and recommend to the Mayor and City Council a compensation
plan, consisting of scales of pay of the several grades or classes
in due relation to each other, and to rates prevailing for like employment
in private industry.
7. To transfer employees from one (1) department to another, for temporary
periods, when the needs of one (1) department are greater than the
department from which the employee is temporarily transferred, in
order to carry on the City's business in an efficient and expeditious
manner, and thereafter to transfer said employee back to the originating
department. Such temporary transfers shall not be deemed to require
adjustments in the budgets of the originating department or the department
to which the employee is transferred for a temporary period.
8. To aid the Mayor and City Council in all practicable ways in handling
other personnel matters relating to office employees.

The City Clerk shall have the power to do all other and further
things necessary or proper for making effective the provisions of
this Article and, in the absence of rules that are applicable, he/she
shall have power to take such action as may be reasonably necessary
and proper to effectuate the purposes of this Article.

A. The
records of the City shall be classified and retained in accordance
with State law, and the latest edition of the Missouri Municipal Records
Manual of the State records management and archives service, which
is hereby incorporated in this Section as if set out at length herein.
B. The
City Clerk is hereby authorized to destroy records as set forth in
the Missouri Municipal Records Manual. (State and Local Records Law,
