The following terms shall have the following meanings:
ADEQUATE FOOD
Foodstuff provided free of contamination by insects, fungus, mold, mildew or other form of spoilage, provided at suitable intervals and in suitable supply for species and age of such animal, sufficient to maintain a reasonable level of nutrition, and provided in a safe dish or container and which is provided at least every twenty-four (24) hours.
ADEQUATE SHELTER
The continuous provision of a structure having a roof, walls, and a floor, which is dry, weatherproof, and made of durable material. At a minimum, the structure must:
1. 
Be sufficient in size to allow each sheltered animal housed in it to stand up, turn around, and lie down;
2. 
Shelter the animal from the adverse effects of the elements, including access to shade from direct sunlight and protection from exposure to inclement weather conditions;
3. 
Be free of standing water and accumulated waste;
4. 
Have adequate ventilation;
5. 
Provide a solid surface, resting platform, pad, floor mat, or similar device that is large enough for the animal to lie on in a normal manner; and
6. 
Have not been declared uninhabitable under the Overland City Code.
ADEQUATE WATER
Potable water of a drinkable temperature which is free from contamination by fecal matter, urine, mold, mildew, bacteria or other forms of spoilage which would make the water unsuitable to be consumed; and provided in a safe dish, container or by another suitable manner, in sufficient volume, and at suitable intervals to maintain normal hydration for the weather conditions and the age, species, condition, size, and type of each animal, but under no circumstances shall such interval exceed twelve (12) hours.
ANIMAL
Any living vertebrate except a human being.
ANIMAL CONTROL OFFICER
Any person(s) or agent(s) employed or designated to enforce this Chapter.
ANIMAL SHELTER
A facility which is used to house or contain animals, and which is owned, operated, or maintained by a duly incorporated Humane Society, Animal Welfare Society, Society for the Prevention of Cruelty to Animals, or other not-for-profit organization devoted to the welfare, protection, and humane treatment of animals.
AT LARGE
Off the premises of the owner, or of anyone having care, custody, or control of the animal, and not under the adequate control of the owner or of anyone having care, custody, or control of the animal. At large shall not include any dog or puppy lawfully off leash in a designated off-leash animal park.
CAT
Any cat, male or female.
CHIEF OF POLICE
The Chief of Police of the City of Overland.
DOG
Any dog, male or female.
DOMESTIC ANIMALS
Any dog, cat or livestock other than poultry.
ENCLOSURE
A fence or structure suitable to prevent the entry of young children and which is suitable to confine a dangerous or potentially dangerous animal in conjunction with other measures which may be taken by the owner or keeper of the animal. The enclosure shall be designed to prevent the animal from escaping.
IMPOUND
To apprehend, seize, catch, trap, net, quarantine, tranquilize or confine an animal in a humane manner.
IMPOUNDING FACILITY
Any facility designated by the Animal Control Officer for the purpose of confining animals impounded pursuant to this Chapter.
KENNEL
The use of land or buildings for the purpose of selling, breeding, boarding or training dogs or cats or the combination thereof or the keeping of four (4) or more dogs or cats or the combination thereof over four (4) months of age.
LIVESTOCK
Horses, mules, cows, sheep, goats, pigs, etc.
OWNER or CUSTODIAN
Any person having a right of property in a dog or cat, or who keeps or harbors a dog or cat, or who has it in his/her care, or acts as its custodian, or who knowingly permits a dog or cat to remain on or about any premises owned or occupied by him/her.
SECURED PEN
A locked pen with sound sides, bottom and top to prevent the entry of young children and to prevent the animal from escaping by climbing, jumping or digging. The pen must be within a reasonable distance of a conspicuous sign warning the presence of a dangerous animal in the pen. Nothing in this Article shall be interpreted as allowing a pen in areas where structures or pets are not authorized by zoning laws.
VETERINARIAN
Any veterinarian holding a current Missouri license and operating on a participating basis with the Health Department, as required by the St. Louis County Rabies Control Code.
