A. 
Created — Composition — Director. There is hereby created the Department of Parks and Recreation for the purpose of establishing recreational programs and maintaining parks for the City. It shall consist of the Director of Parks and Recreation, who shall serve as head of the department, and all other officers and employees assigned thereto. All such officers and employees shall perform their duties subject to the supervision of the Director.
B. 
Director's Duties. The Director of Parks and Recreation shall:
1. 
Have charge of and supervision over the planning, direction and coordination of diversified year-round recreation programs for the residents of the City;
2. 
Recommend parks and recreation policies and programming to the Parks and Recreation Commission for review;
3. 
Train and supervise the parks and recreation staff;
4. 
Plan and schedule adequate parks and recreation maintenance programs to ensure the upkeep of City parks and recreation facilities;
5. 
Formulate park improvements for review by the Parks and Recreation Commission and supervise these improvements, including landscaping, structures and recreational facilities;
6. 
Prepare and submit to the City Administrator and Parks and Recreation Commission a monthly activities report;
7. 
Prepare and submit to the City Administrator an annual departmental budget after review and approval of such budget by the Parks and Recreation Commission;
8. 
Assist the Zoning Enforcement Officer in reviewing all plans and applications for recreational special use permits, coordinating this review with the Parks and Recreation Commission.
C. 
Appointment Of Director. The Director of Parks and Recreation shall be appointed by the City Administrator with the approval of the majority of all the members of the City Council for an indefinite term of office, and may be removed from office on the recommendation of the City Administrator with the consent of the majority of all the members of the City Council.
D. 
Director's Responsibilities.
1. 
The Director of Parks and Recreation shall be accountable to the City Administrator and at all times is subject to the supervision, direction and control of the City Administrator.
2. 
The Director of Parks and Recreation shall, in addition to the duties outlined in this Section, meet regularly with the Parks and Recreation Commission and other special or standing boards and committees as may be required by the Mayor or the City Administrator.

A. 
Commission Established.
1. 
There is hereby established a Parks and Recreation Commission of the City which shall consist of nine (9) members with two (2) members being appointed from each of the City's four (4) wards and a member of the City Council selected by the City Council, if the Council chooses to have a member serve on the Commission and one (1) member appointed, at-large, by the Mayor. The members of the Parks and Recreation Commission shall be appointed by the Mayor subject to the approval of a majority of the City Council. Members of the Parks and Recreation Commission shall serve for a term of two (2) years or until their successors are appointed and qualified. Nothing herein contained shall prevent a member from succeeding himself/herself.

In the event of a vacancy, a new member shall be appointed by the appointing Council member to fill the unexpired term. All members of the Parks and Recreation Commission shall serve without compensation. All members of the Parks and Recreation Commission shall be subject to removal by a majority vote of the City Council.
B. 
Organization. The Parks and Recreation Commission shall, annually, in September, within fifteen (15) days after the appointment of the members whose terms expire each year, meet and elect one (1) of their members as president and shall elect such other officers as the members of the Commission may deem necessary.
C. 
Rules And Regulations. The Commission established under this Section shall adopt and promulgate such rules and regulations for the conduct, operation and maintenance of the recreational system within the City which shall consist of parks, park areas, historical sites, playgrounds, swimming pools, gardens and other recreational areas owned or used by the City as the Commission may deem necessary. Such rules and regulations shall be subject however, to the approval of a majority of the City Council.
D. 
Duties And Authority. The Parks and Recreation Commission shall be a recommending body only and shall make its recommendations to the City Council for the operation and maintenance of the recreational system within the City which shall consist of parks, park areas, historical sites, playgrounds, swimming pools, gardens and other recreational areas owned or used by the City for its final determination as to what action should be taken. The City Council may from time to time delegate certain authority and responsibilities to the Parks and Recreation Commission for the proprietary functions to be performed in connection with the duties of the Parks and Recreation Commission.

A. 
The City parks shall be open to the public from one-half (1/2) hour before sunrise to one-half (1/2) hour after sunset daily, except for the following facilities: Tennis court facility at Woodson Road Park which shall be open until 10:30 P.M. and athletic fields, subject to the issuance of a field permit, at Legion Park which shall be open until 11:00 P.M. and Woodson Road Park, which shall be open until 10:30 P.M.
B. 
It shall be unlawful for any person or vehicle to use any City park prior to or after the hours established for public use, except in cases where a park reservation permit or field permit has been issued by the Director of Parks and Recreation.
C. 
Any person who violates the provisions of this Section shall be deemed guilty of a misdemeanor.

A. 
It shall be unlawful for any person to operate a bicycle, skateboard, roller skates or roller blades within the Overland Wild Acres Park.
B. 
Dogs are permitted, within Wild Acres Park, only when restrained in accordance with the provisions set forth in Section 215.180.
C. 
Any person who violates the provisions of this Section shall be deemed guilty of a misdemeanor.

The community center which is currently under construction at Goodale Avenue and Lackland Road, shall hereafter be known, named and designated "Frank Munsch Community Center". Policies and procedures for the use of the Frank Munsch Community Center described in Exhibit "A" attached to Ordinance No. 93-62 are hereby adopted and incorporated herein as if fully set out in this Section.

An Overland resident identification card is required for any person six (6) years of age and over for use of the community center, swimming pool and tennis courts.
To obtain an Overland resident identification card, proof of residency is required. Such proof shall be a current occupancy permit, if applicable, plus one (1) of the following: Current Missouri driver's license or other Missouri I.D. or paid real estate or personal property tax receipt. Persons under the age of sixteen (16) years must be accompanied by a parent or legal guardian to obtain a card and the same proof of residency and full fee will be required. The child must either live with or be under legal custody of the adult with whom the child comes to receive an identification card.
Persons residing at their current residence prior to enactment of the occupancy permit requirement (January 13, 1975) shall not be required to show an occupancy permit and an alternate proof of residency shall be at the discretion of the City Clerk.

A. 
Prohibited Fishing. No person shall fish in any waterways in Wild Acres Park, whether off-shore or by boat and whether by the use of hook-and-line, net, trap or other device, except in waterways designated by the Director for that use and under such regulations and restrictions as provided for herein or may be later prescribed by the Director. No person shall fish, at any time, in any area designated for bathing or swimming.
B. 
Authorized Fishing. Where fishing is authorized, all persons shall comply with Missouri State law and such regulations of the Director in the pursuit of fish, crawfish and other waterbound wildlife in Wild Acres Park waterways.
C. 
Fish Stocking Prohibited. No person shall place or cause to be placed any fish or other aquatic life, unless acting under written authorization of the Director, in any waterway in or adjacent to any Wild Acres Park or into any stream, tributary or other waterway flowing into such waters for any purpose.
D. 
Creating Fish Habitat Prohibited. No person shall place or cause to be placed any brush, debris, or other material or thing, unless acting under written authorization of the Director, in any waterway in a Wild Acres Park for the purposes of creating or enhancing the habitat for fish or other aquatic life.
E. 
Fish Cleaning. No person shall clean fish while in the park.
F. 
Commerce Prohibited. No person shall engage in commercial fishing or the buying and selling of fish, crawfish or other waterbound wildlife caught in any waterways in Wild Acres Park.

A. 
When Required. A permit approved by the Director of Parks and Recreation, or City Council shall be obtained from the City before any exclusive use of any City Park or Park facility or portion thereof will be permitted.
B. 
Permit Effect. No person not invited by a permittee shall loiter or remain in or on any City Park facility reserved by an issued permit.
C. 
Permit Application. Applications shall be submitted, in writing, in advance of the proposed use on a form provided by the City.
D. 
Permit Requirements.
1. 
Code Compliance. Any permittee shall, as a condition of issuance of a permit, be bound by all City Park rules, regulations, and policies and all applicable provisions of the Municipal Code as though fully inserted into the issued permit.
2. 
Waiver. Any permittee shall, as a condition of issuance of a permit, agree to a waiver and release of liability provision and indemnification agreement. The permittee shall also, as a condition of any permit issued, be responsible for the cost of any damage to City Park facilities or other property occurring during such permitted event and, depending on the type of permit, may be required to submit a deposit to cover any such damage prior to issuance of any permit.
3. 
Insurance Required. The City reserves the right to review any activity involving the use of any City facility and impose specific insurance requirements based upon perceived risks related to the use of the facility. Nothing in this requirement or the insurance shall be deemed a waiver of the City's sovereign immunity. Upon request, the City Council may waive or modify these insurance requirements upon good cause shown.
E. 
Permit Fees. A schedule of fees shall be kept on file with the Department of Parks and Recreation and the Office of the City Clerk.
F. 
Permit Standards. The Director of Parks and Recreation or their designee may issue a permit when he/she finds that:
1. 
The proposed activity or use will not unreasonably interfere with or detract from the general public enjoyment of the City Park;
2. 
The proposed activity and use will not unreasonably interfere with or detract from the promotion of public health, welfare, safety, and recreation;
3. 
The proposed activity or use is not reasonably anticipated to incite violence, crime, or disorderly conduct;
4. 
The proposed activity will not entail unusual, extraordinary, or burdensome expense or police operation by the City; and
5. 
The City Park facilities desired have not been reserved for other use at the day and hour requested in the application.
G. 
City Council Approval Required When. City Council approval is required where any permit requests closure of an entire City Park or when, based on the number of expected participants or desired events, the Director of Parks and Recreation reasonably determines such permit requires facilities or areas to be closed in addition to the desired rental facilities. City Council approval shall also be required when City services are requested or if the Director of Parks and Recreation reasonably determines that City services are required to meet the above permit standards.
H. 
Revocation. The Director of Parks and Recreation shall have the authority to revoke a permit issued pursuant to this Section upon a finding of violation of any rule or any provision of the Municipal Code or other City ordinance, rule, or policy applicable to use of such permitted area, or upon good cause shown. If a permit is revoked, a refund will not be provided.
I. 
Cancellation. The Director of Parks and Recreation shall have the authority to cancel a permit issued pursuant to this Section due to inclement weather conditions or upon other good cause shown. Refunds for cancellations, either by the Director of Parks and Recreation or by the permittee, shall be in accordance with the City's refund policy, on file with the Department of Parks and Recreation and the Office of the City Clerk. Upon request, the City Council may waive or modify the provisions of the refund policy upon good cause shown.
J. 
Appeal. Any person aggrieved by denial, revocation, or cancellation of a permit of a permit, by Director of Parks and Recreation, may appeal such decision to the City Council.
K. 
Supervision. The Director of Parks and Recreation shall generally oversee the permits issued hereunder.
