Township of Little Falls, NJ On-Street Regulations

Words and phrases. Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the New Jersey Statutes shall be deemed to apply to such words and phrases used herein.

7-1.2

Official time standard. Whenever certain hours are named in this chapter, they shall mean either Eastern standard time or Eastern daylight saving time as may be in current use.

§ 7-2 Authorization for the closing of any street.

The Mayor, or, in the event of his absence, disability or inability to act, then the Chief of Police or the ranking Police Officer is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours whenever he finds that such closing is necessary for the preservation of the public safety, health or welfare.

Any regulations promulgated by the Mayor and in accordance with Subsection A above shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.

Any violation of this regulation promulgated hereunder shall be punished by a fine not to exceed $50.

Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

§ 7-3 Tow-away.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

§ 7-3.1 Signage.

Appropriate signage shall be posted as required and conform to the requirements of Title 39 of the New Jersey Statutes Annotated and the current Manual on Uniform Traffic Control Devices as published by and for the State of New Jersey. Any and all traffic control signs and devices shall be appropriately designed and installed in accordance with the aforementioned statutes and rules and regulations and posted at all appropriate locations in the Township of Little Falls, County of Passaic, and State of New Jersey, as required by law.

§ 7-5 Effect of ordinance.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

§ 7-6 Repeal.

All former traffic ordinances of the Township of Little Falls that are contained in this chapter are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

§ 7-7 Parking regulations not exclusive.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey statute or as hereinafter provided.

§ 7-8 Parking prohibited during state of emergency.

Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.

Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle. Any violation of this section shall be punishable by a fine of $100 per offense. No appearance in municipal court shall be required for the payment of this fine.

The effectiveness of this section is contingent upon the signs being erected as required by law.

§ 7-9 Temporary parking prohibition for snow plowing and removal.

Whenever snow has fallen and the accumulation is such that it covers the streets and highways, an emergency shall exist and no vehicle shall be parked on any of the streets or highways or portions thereof within the Township of Little Falls.

The above parking prohibitions shall remain in effect after the snow has ceased until the streets have been plowed sufficiently and to the extent parking will not interfere with snow plowing or the normal flow of traffic.

Any unoccupied vehicle parked or standing in violation shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any police officer may provide for the removal of such vehicle. § 7-11 Parking time limited on certain streets. [1]

No person shall cause or permit to be parked any motor vehicle upon street between the specified hours and days described.

§ 7-15 Routes for trucks over 13 tons.

A system of truck routes in the Township of Little Falls is hereby established pursuant to the provisions of N.J.S.A. 40:67-16.1.

All trucks registered at a gross vehicle weight in excess of 13 tons (26,000 pounds) shall be excluded from all streets in the Township except from those streets designated hereinbelow, which form a part of the system of truck routes upon which trucks are permitted to travel and operate:

Signage for truck routes shall be provided by the Township in accordance with N.J.S.A. 40:67-16.4.

Any violation of this section shall be punishable by a fine of $125 per offense. No appearance in Municipal Court shall be required for the payment of this fine.

"Truck" is hereby defined as its definition is set forth in Title 39, Motor Vehicle and Traffic Laws of the State of New Jersey as same may be amended from time to time.

Nothing herein shall be construed to prohibit any truck from any state highway route within the Township.

This section shall be enforced by the Police Department of the Township of Little Falls as well as any other law enforcement agency or department. The penalty for a violation of any of the provisions of the within section shall be a fine of $100 per offense. No appearance in municipal court shall be required for the payment of this fine.

§ 7-16 Overnight parking of certain vehicles prohibited.

It shall be unlawful for the owner or operator of a truck (including without limitation vans and pickup trucks); tractor trailer; semitrailer; commuter van; school bus, including Type I and Type II buses; omnibus vehicle (including taxis); motorized mobile home (a vehicle with sleeping, kitchen, or bathroom facilities), used for commercial purposes, as defined by New Jersey Motor Vehicle and Traffic Regulations 39:1-1,[1] to park such vehicle on any street in the Township of Little Falls between the hours of 9:00 p.m. and 6:00 a.m. prevailing time.

Such vehicles shall not be prohibited from actively engaging in legitimate trade, business, or commerce for which they were designed, such as delivering goods and services, but shall only prohibit passive parking. However, all such vehicles actively engaged as such shall cease from parking on the street by 9:00 p.m. prevailing time.

§ 7-29 Handicapped parking.

Handicapped parking on streets. In accordance with the provisions of N.J.S.A. 39:4-197, the following on-street locations are designated as handicapped parking places. § 7-30 Midblock crosswalks.

Midblock crosswalks on streets. In accordance with the provisions of N.J.S.A. 39:4-8(d), the following on-street locations are designated as midblock crosswalks. Such spaces are for use by pedestrians for crossing roadways away from intersections in marked designated crosswalk areas distinctly indicated by lines or markings on the roadway surface.

The installation or placement of such crosswalks shall be consistent with the standards prescribed by the Manual on Uniform Traffic Control Devices for Streets and Highways. In addition, the Clove Road crosswalk shall have flashing beacon signs installed on both the northbound and southbound lanes prior to the crosswalk.

§ 7-31 Safety sticks.

[Added 10-16-2023 by Ord. No. 1470]

Purpose. The Township has deployed safety sticks technology at various locations to monitor parking activity and enforce parking regulations in certain no-parking zones such as fire hydrants, bus stops, crosswalks, and loading zones.

Violations and penalties. Any person who violates the provisions of this section of the Code shall be punished by a fine in the amount of $50 per offense. A separate offense shall be deemed committed on each day the vehicle remains parked in violation of this article. No court appearance is necessary.

Removal of vehicles. Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage, which may result from such removal, before regaining possession of the vehicle.

Enforcement. Enforcement of this article and further rules and regulations as may be promulgated from time to time shall be under the jurisdiction the Police Department of the Township of Little Falls
