Peters Township Ordinance No. 500, August 22, 1994, amended
by Ordinance No. 560, June 8, 1998, is replaced, with the exception
that any existing provisions exceeding the "Code" are maintained;
these are:
A. Section 101.1. That the name of the jurisdiction "Peters Township"
be inserted herein.
B. Section 113.0. Means of appeal. Delete in its entirety and substitute
"Ordinance No. 379, adopted June 8, 1987."
C. Section 307.0 Open burning. Delete in its entirety. Add the following: Open burning is regulated by Chapter
147, Burning, Open, as may be amended by Peters Township.
D. Section 3201.6 of the State Code as follows:

All underground tank storage shall comply with the provisions
of the Commonwealth of Pennsylvania Flammable and Combustible Liquids
Handbook, Revised 1984, Title 37 Pa. Code Chapters 11 and 13.

E. Section 3301 Explosives and fireworks. Add the following to Section
3301.1, Scope: The sale and discharge of fireworks shall comply with
all laws of the Commonwealth of Pennsylvania.
Administration and enforcement of the Code within Peters Township
shall be undertaken in any of the following ways as determined by
the governing body of this Township from time to time by resolution:
A. By the designation of an employee of the Township to serve as the
Township Code Official to act on behalf of the Township;
B. By the retention of one or more Construction Code Officials or third-party
agencies to act on behalf of the Township;
C. By agreement with one or more other townships for the joint administration
and enforcement of this Act through an intermunicipal agreement;
D. By entering into a contract with another municipality for the administration
and enforcement of this Act on behalf of this Township;
E. By entering into an agreement with the Pennsylvania Department of
Labor and Industry for plan review, inspections and enforcement of
structures other than one-family or two-family dwelling units and
utility and miscellaneous use structures.
Any person who violates or permits a violation of this article
shall, upon conviction in a summary proceeding brought before a Magisterial
District Judge under the Pennsylvania Rules of Criminal Procedure,
be guilty of a summary offense and shall be punishable by a fine of
not more than $1,000, plus costs of prosecution. In default of payment
thereof, the defendant may be sentenced to imprisonment for a term
not exceeding 90 days. Each day or portion thereof that such violation
continues or is permitted to continue shall constitute a separate
offense, and each section of this article that is violated shall also
constitute a separate offense.

The Township Manager shall certify to the adoption of this article
and cause the same to be published as required by law; and this article
shall take full force and effect five days after this date of final
passage and approval.
