A. All owners of property connected or connecting with the sewers and
sewage system as owned or leased by the Township of Lower Burrell,
Westmoreland County, Pennsylvania, and all of the owners of property
who may hereafter connect with and use the same shall pay sewer rentals
or charges, payable quarterly as hereinafter provided, for the use
of such sewage facilities based upon the schedule of rates below,
which may be amended by resolution from time to time:
(1) For residential users of said sewers and residential properties to
which the system is available for use, the following rate schedule
will be used for quarterly billing:

B. There shall be a penalty assessed in the amount of 7% which shall
be added to all bills paid later than 15 days after the date of said
bill.

C. A disconnect/reconnect billing fee in an amount set by the Water
Authority shall be assessed when water service is either disconnected
or reconnected.

D. This article may be changed from time to time by resolution of Council.
E. All property owners who are connected to the sewage system or who
have access to the sewage system, shall pay the base rate whether
or not they are actively putting sewage into the system.

F. A $10
posting fee per notice shall be assessed for preparing and posting
notice that water service to a property will be disconnected for nonpayment
of sewer rentals or charges.

Sewer rentals or charges shall be paid quarterly in accordance
with billings for sewage service; however, during the first month
that a residential, commercial or industrial user begins to discharge
sewage into the sewage system, said charge shall be based on a per
diem pro rata amount from the time such sewer connection is made until
the next following quarterly billing period. Quarterly charges for
sewage service shall be due and payable immediately upon receipt and
shall be paid not later than the 10th day following the date of billing.

Sewers heretofore constructed by real estate developers or others
and designed to serve groups of properties and which have been determined
by the consulting engineer of the Municipal Authority of the City
of Lower Burrell to have been properly installed and usable in connection
with the sewage collection system of the City of Lower Burrell may
be connected to and incorporated into said sewage collection system
upon the condition that a tap-in fee shall be paid to the City of
Lower Burrell in the operation of said sewer system for each residential
property served or which may be served by said privately constructed
sewer system or systems.

A. The sewer tap-in fees for connection to existing sewers or sewers
hereinafter constructed shall be those recommended sewer tap-in fees
set forth in the November 2010, revised December 21, 2010, Schedule
prepared by Alpha Engineering Co., Inc., which schedule is included
below. The Fee Schedule is approved in accordance with Third Class
City Code, Section 3215, 53 Pa.C.S.A. § 38214.1 and the Pa. Municipality Authorities Act, 53 Pa.C.S.A.
§ 5607.

B. The fee
structure of this section may be changed from time to time by resolution
of the Council of the City of Lower Burrell.
Neither the City of Lower Burrell nor Municipal Authority of
Lower Burrell, Westmoreland County, Pennsylvania, shall be liable
for any damage resulting from leaks, broken pipes or from any other
cause occurring to or within any house or building between the sewer
line and any house or building, and neither said City nor Authority
shall be liable to any owner for any claim for damage arising by reason
by leaking or breaking of any main, trunk, interceptor, lateral or
building connection, sewer line or any attachment to the sewer.
The duly authorized agents of the City of Lower Burrell and
Municipal Authority of the City of Lower Burrell, Westmoreland County,
Pennsylvania, shall have access at all reasonable hours of the day
to all parts of the premises to which sewer service is supplied to
make necessary inspections.
