No person or legal entity shall permit or cause to be covered,
in any manner or to any extent whatsoever, any sanitary or storm sewer
manhole or otherwise render the same inaccessible in any manner to
the City of Lower Burrell, the Lower Burrell Municipal Authority or
the entity which operates the sanitary or storm sewer systems or any
of their agents, servants, workmen, employees or any other persons
legally authorized to have access to the sanitary or storm sewer system.
In the event that any person or legal entity desires to cover
a manhole of the sanitary or storm sewer systems whether by fill,
grading or any other method, they shall first present their request
to the Mayor and Council of Lower Burrell or any successor entity
which operates the sewer systems. If Council approves the request,
Council may require the person, legal entity or owner of the property
to pay for, either in whole or in part or install a means of access
to the manholes in question.
Upon the failure of any person, legal entity or owner to pay
for or provide access to the manholes, the same may be done or caused
to be done by the City and the cost thereof to be levied and collected
from them by any and all legal proceedings available to the City,
including but not limited to a lien on the property.
Any person or legal entity, which jointly or severally violates
any provision of this article shall, upon conviction before a Magisterial
District Judge or other court, be subjected to a fine of not more
than $1,000 including costs. Each day a violation exists shall constitute
a separate offense. In default of payment of such fine and costs,
such person or legal entity may be subject to imprisonment in the
county jail.
