Should any section or provision of this chapter be decided by
the courts to be unconstitutional or invalid, such decision shall
not affect the validity of the ordinances as a whole, or any part
thereof other than the part so held to be unconstitutional or invalid.
This zoning ordinance of Mathews County, Virginia, was duly
considered, following a required public hearing held on January 29,
1987, and was adopted by the Board of Supervisors of Mathews County
on January 29, 1987. This chapter shall be effective at and after
12:01 a.m. on January 30, 1987.
All ordinances or portions of ordinance in conflict with this
chapter are hereby repealed to the extent necessary to give this chapter
full force and effect.
Whenever these standards are at variance with the requirements
of any other lawfully adopted statutes, rules, regulations or ordinances,
the most restrictive, or that imposing the higher standards, shall
govern.
The zoning of any land and the granting of any permit or certificate
for the use of land and/or structure shall not be interpreted as a
guarantee by the County of Mathews of the suitability of such land
or structure for development or use.
It is not the intent of this chapter to exclude any economic, racial, religious or ethnic group from enjoyment or residence, land ownership, or tenancy within the County nor is it the intent of this chapter to use public powers in any way to promote the separation within the County of economic, racial, religious or ethnic groups, except as may be the incidental result of meeting the purpose outlined in §
175-1.3 herein.
