For purposes of this Chapter, the following terms, words and
phrases shall mean:
COMMERCIAL TRAILER
Any vehicle without motor power designed for carrying property
or passengers on its own structure and for being drawn by a commercial
motor vehicle, including a semi-trailer or vehicle of the trailer
type so designed and used in connection with a commercial motor vehicle
so that a considerable part of its own weight rests upon and is carried
by the towing motor vehicle.
COMMERCIAL VEHICLE
A motor vehicle designed or used for:
1.
Carrying freight and/or merchandise; or
2.
Drawing or hauling a trailer, equipment or other motor vehicles;
or
3.
Transporting more than eight (8) passengers; or
4.
Offered for hire or lease; or
5.
Used for business purposes and having displayed or affixed thereon
a sign or printing identifying a business, institution, product or
service.
GROSS WEIGHT
The weight of a motor vehicle and/or vehicle combination
without load, plus the load.
MOTOR VEHICLE
Any self-propelled vehicle not operated exclusively upon
tracks or rails.
MOTOR VEHICLE OWNER
Any person, firm, corporation or association who holds the
legal title to a vehicle or, in the event a vehicle is the subject
of an agreement, for the conditional sale or lease thereof with the
right of purchase contingent upon performance of conditions stated
in the agreement and with an immediate right of possession vested
in the conditional vendee or lessee or in the event a mortgagor of
a vehicle is entitled to possession, then such conditional vendee
or lessee or mortgagor shall be deemed the owner for purposes of this
Chapter.
OVERSIZED COMMERCIAL VEHICLE
Any commercial vehicle being twenty-seven (27) feet or more
in length or having three (3) or more axles or having a gross weight
of eighteen thousand (18,000) or more pounds.
OWNER OF REAL PROPERTY
Any person, firm, corporation or association who holds the
legal title or who is in actual possession or who has charge, care
or control of real property within the City of Pasadena Hills or the
employee or agent of the owner or trustee or guardian of the estate
of the person or property of the owner of such real property.
PERSONAL UTILITY TRAILER
Any vehicle without motive power designed for carrying property
or passengers on its own structure and for being drawn by a self-propelled
vehicle which is not used in conjunction with a commercial vehicle.
RECREATIONAL EQUIPMENT
Any equipment such as travel trailers, pickup campers or
coaches, motorized campers, tent trailers, boats and boat trailers
and the like and cases, boxes or trailers for transporting recreational
equipment, whether occupied by such equipment or not.
RECREATIONAL VEHICLE
Any vehicle used for sport or recreation including, but not
limited to, all-terrain vehicles, boats and other watercraft, campers
and large vehicles capable of being used for temporary housing.

A. Repair Of Vehicles. No person shall engage in the repair
of vehicles or the storage of unlicensed, inoperable, derelict, antique
or historic vehicles in excess of twenty-four (24) hours unless such
vehicles are housed in fully enclosed garages.
B. Public Streets And Other Public Property.
1. No person shall park or allow to stand a commercial vehicle, oversized
commercial vehicle or commercial trailer on any street, alleyway,
thoroughfare or public property within the City of Pasadena Hills,
except while collecting or delivering freight or merchandise, transporting
passengers or providing business services at premises within the City
of Pasadena Hills between the hours of 7:00 A.M. and 10:00 P.M.
2. Under no circumstances shall a commercial vehicle, oversized commercial
vehicle or commercial trailer remain parked or standing on any street,
alleyway, thoroughfare or public property between the hours of 10:01
P.M. and 6:59 A.M.
3. No person shall park or allow to stand a recreational vehicle or
recreational equipment on any street, alleyway, thoroughfare or public
property within the City of Pasadena Hills.
C. Private Property.
1. No person shall operate, drive, park or allow to stand a commercial
vehicle, oversized commercial vehicle and/or a commercial trailer
on private property within the City of Pasadena Hills, except while
collecting or delivering freight or merchandise, transporting passengers
or providing business services at premises within the City of Pasadena
Hills between the hours of 7:00 A.M. and 10:00 P.M.
2. No owner of real property shall permit the operation of or parking
or storing of a commercial vehicle, oversized commercial vehicle and/or
a commercial trailer on privately owned property within the City of
Pasadena Hills, except while such vehicle is being used for the purpose
of collecting or delivering freight or merchandise, transporting passengers
or providing business services at such premises within the City of
Pasadena Hills between the hours of 7:00 A.M. and 10:00 P.M.
3. No owner of real property shall park, store or allow to stand a recreational
vehicle, recreational equipment or personal utility trailer on privately
owned property within the City of Pasadena Hills unless such recreational
vehicle, recreational equipment or personal utility trailer is within
an enclosed garage.
Exceptions:
a. A boat (and its associated trailer) may be parked or stored on privately
owned property provided:
(1)
The boat is parked or stored on an improved surface behind the
front building line of the structure on such property;
(2)
The boat is covered with a form-fitting cover designed for the
particular type of boat; and
(3)
Such parking or storage does not encroach upon the required
off-street parking for standard passenger vehicles.
b. Recreational equipment or recreational vehicles, for purposes of
loading or unloading, may be parked on any private driveway or street
immediately adjacent to property owned or occupied by the owner of
such vehicle but no such parking shall exceed twenty-four (24) hours
in any thirty (30) day period.
c. A personal utility trailer may be parked or stored on privately owned
property provided:
(1)
The trailer is parked or stored on an improved surface behind
the front building line of the structure on such property; and
(2)
Such parking or storage does not encroach upon the required
off-street parking for standard passenger vehicles.

A. Commercial Vehicles And Trailers.
1. In the event of a construction project justifying the extension of
the time limits set forth in this Chapter, the Chief of Police of
the City of Pasadena Hills shall, upon application, issue a temporary
permit to the owner or operator of a commercial vehicle, oversized
commercial vehicle or commercial trailer allowing an extension of
time to reasonably complete said construction project, provided:
a. Said commercial vehicle, oversized commercial vehicle or commercial
trailer is parked or kept on the property undergoing the construction
project; and
b. No part of the commercial vehicle, oversized commercial vehicle or
commercial trailer is parked or kept on any public street, alley or
thoroughfare; and
c. The commercial vehicle, oversized commercial vehicle or commercial
trailer is parked or kept in such a manner so as to not block or hinder
motor or pedestrian traffic and so as to not distract motorists.
2. In the event of other special needs or hardships justifying the extension
of the time limits set forth in this Chapter, the Chief of Police
of the City of Pasadena Hills may, upon application, issue a permit
to the owner or operator of a commercial vehicle allowing an extension
of time up to forty-eight (48) hours, provided that the owner complies
with subparagraphs (a) through (c) above.
B. Recreational Vehicles.
1. Recreational equipment or recreational vehicles may be parked within
the City if the owner thereof has secured a temporary permit which
may be issued by the Chief of Police.
2. Any such permit shall be for a maximum fourteen (14) days for any
six (6) month period of time.
3. In issuing the permit, the Chief of Police shall consider the size
of the equipment or vehicle, the area in which the equipment and vehicle
will be parked, the extent of available screening, whether such parking
will adversely affect the character of the neighborhood; whether such
parking will adversely affect the general welfare of the community;
whether such parking will substantially interfere with the protection
of property on which the vehicle is parking with relation to fire
and Police protection; and whether such parking will substantially
interfere with the enjoyment of neighbors in relation to vision, appearance
and utilization of their property.
4. All permits shall be subject to the following conditions:
a. All recreational equipment and recreational vehicles shall be kept
in good repair;
b. No repair work shall be performed on the vehicle at any time;
c. Recreational equipment and recreational vehicles shall not have fixed
connections to electricity, water, gas or sanitary sewer facilities
and at no time shall the equipment or vehicle be used for living or
housekeeping purposes;
d. No equipment or vehicle shall be parked on any unpaved surface and
no equipment or vehicle shall overhang the limits of such paved surface;
and
e. All other conditions set by the Chief of Police in considering the
factors in subparagraph (3) above.

Notwithstanding the foregoing, nothing contained herein shall
be construed to prohibit or regulate the use, operation or parking
of any commercial vehicle, oversized commercial vehicle or commercial
trailer being used in connection with a life or property saving emergency
or the construction, repair or maintenance of public property or the
collection of garbage or refuse within the City of Pasadena Hills.

Any person violations any of the provisions of this Chapter
shall, upon conviction, be subject to a fine of not less than fifty
dollars ($50.00) and no more than one thousand dollars ($1,000.00).
Each day a violation exists shall be deemed a separate offense.
