Pursuant to RSA 31:39, it shall be unlawful, unless approved by the voters of the Town, for any individual, partnership, corporation or other entity to maintain, within the Town of Conway, any privately owned or privately operated dump, storage place or other facility primarily used for the collecting, receiving, processing, reprocessing, treatment, recovery, storage, disposal or burial of hazardous waste.
For the purpose of this chapter, the following terms shall have the meanings indicated:
HAZARDOUS WASTE
A solid, semisolid, liquid or contained gaseous waste or any combinations of these materials which:
A. 
Because of either quantity, concentration or physical, chemical or infectious characteristics may cause or contribute to an increase in mortality or an increase in irreversible or incapacitating reversible illness, or pose a present or potential threat to human health or the environment when improperly treated, stored, transported, disposed of or otherwise mismanaged.
B. 
Has been identified as a hazardous waste by the New Hampshire Bureau of Solid Waste Management, using the criteria established under RSA 147-A:2. Such wastes include, but are not limited to, those which are radioactive, toxic, corrosive, ignitable, irritants, strong sensitizers or which generate pressure through decomposition, heat or other means.
