A permit shall be obtained before any parade may be conducted
in the City. Said parade permit shall be issued or denied in accordance
with this Chapter after the completion and submission of a "Parade
Permit Application," a copy of which is attached hereto and marked
"Exhibit A."[1]

No procession or parade containing twenty-five (25) or more
persons or ten (10) or more vehicles, except the military forces of
the United States, the military forces of this State and the forces
of the Police and Fire Departments, shall occupy, march or proceed
along any street except in accordance with a permit issued by the
Chief of Police and such other regulations as are set forth herein
which may apply. The Chief of Police shall have the right to automatically
deny any application for such a permit if not submitted at least thirty
(30) days prior to the requested parade date.

A.
Any person aggrieved by the denial of a parade permit shall
have the right to appeal the denial in the following manner:
1.
Within five (5) days of the denial of the request,
the appeal shall be taken to the City Mayor, who will hear the appeal
within three (3) business days of the request; and
2.
If the City Mayor upholds the denial of the parade
permit, the appealing party may, by filing notice within five (5)
days of the above finding, bring his or her appeal before the entire
City Council at its next regular public meeting.

A.
No denial of issuance of a parade permit shall be upheld
unless the person or body hearing the appeal finds that:
1.
The conduct of the parade will substantially interrupt
the safe and orderly movement of other traffic contiguous to its route;
2.
The conduct of the parade will require such diversion
of so great a number of police officers of the City to properly police
the line of movement and the area contiguous thereto as to prevent
normal police protection to the City;
3.
The conduct of such parade will require the diversion
of so great a number of ambulances as to prevent normal ambulance
service to portions of the City other than that to be occupied by
the proposed line of march and areas contiguous thereto;
4.
The concentration of persons, animals and vehicles
at assembly points of the parade will unduly interfere with proper
fire and police protection of, or ambulance service to, areas contiguous
to such assembly areas;
5.
The conduct of such parade will interfere with
the movement of firefighting equipment en route to a fire;
6.
The parade is not scheduled to move from its point
of origin to its point of termination expeditiously and without unreasonable
delays en route;
7.
The parade will unduly interfere with businesses
and retail establishments along said routes; or
8.
The parade is to be held for the sole purpose
of advertising any product, goods or event, and is designed to be
held purely for private profit.
