The proper officers of the Township are hereby authorized and directed to execute and deliver on behalf of the Township the intergovernmental cooperation agreement (the "agreement"), in substantially the form attached hereto as Exhibit "A,"[1] with respect to the creation, powers, requirements and implementation of a Tobyhanna Water Service Area.

The agreement shall be entered into by and between the Township and the BCRA in order to create, establish and implement a Tobyhanna Water Service Area to be served exclusively by the BCRA and requiring mandatory connections for the properties located within the Tobyhanna Water Service Area as described therein. The agreement shall also require the BCRA to comply with certain construction and rate requirements in accordance with Tobyhanna Township Code of Ordinances and the Pennsylvania Municipality Authorities Act.[1]

The proper officers of the Township are hereby authorized and directed to take all such actions, execute, deliver, file and/or record all such documents, publish all notices and otherwise comply with the provisions of this article and the Act insofar as the transaction contemplated by this article, in the name and on behalf of the Township.
