As used in this Part, the following terms shall have the following meanings unless the context clearly indicates that a different meaning is intended:
BOROUGH
Biglerville Borough.
CHIEF OF POLICE
Chief of Police of Biglerville Borough.
MOTOR VEHICLE
A vehicle which is self-propelled, except one which is propelled solely by human power or by electric power obtained from overhead trolley wires, but not operated upon rails.
SNOW EMERGENCY AND/OR ICE EMERGENCY
Declared when there is accumulation of three inches of snow or any amount of ice. A sign with this designation shall be placed along the snow emergency routes.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, except devices used exclusively upon rails or tracks.

In order to facilitate the movement of traffic and to combat the hazards of snow and ice on the snow emergency routes designated in § 15-504 of this Part and the no parking zones designated in § 15-505 of this Part, the Borough police officer in charge at the time, or if no Borough police officer is on duty, the Chairman of the Highway/Property Committee, or if he or she is unavailable, the President of the Borough Council, in the aforesaid designated person' s discretion, may declare a snow and/or ice emergency (designated in this Part as a "snow emergency and/or ice emergency"). Information regarding the enactment of a snow emergency shall be relayed to the Borough citizens through all available media possible by the Borough office.

After any snow emergency is declared, it shall be unlawful, at any time during the continuation of the snow emergency, for any person:
A. 
To park a vehicle or to allow that vehicle to remain parked anywhere on any snow emergency route designated in § 15-504 of this Part or on any no parking zone designated in § 15-505 of this Part; or
B. 
To drive any motor vehicle on any such snow emergency route, unless that motor vehicle is equipped with snow tires, chains or tires approved by the Pennsylvania Turnpike Commission.

If, at any time during a period of snow emergency declared under § 15-501 of this Part, a person shall park a vehicle or allow a vehicle to remain parked anywhere upon a snow emergency route or in a snow emergency no parking zone, that person shall be guilty of a violation of this Part, and, upon conviction, shall be sentenced to pay a fine of not more than $25 and costs of prosecution. Each day that a vehicle remains parked in violation of § 15-503 of this Part shall constitute a separate violation of this Part.

Any vehicle which has been ticketed for violation of this Part shall be immediately removed by its owner either from the snow emergency route or snow emergency no parking zone. If the motor vehicle is not removed from the snow emergency route or the snow emergency no parking zone within one hour of being ticketed, the Borough shall have the authority to remove and impound or to order the removal and impoundment of any vehicle which remains parked in violation of this Part, pursuant to the provisions and procedures contained in this Part authorizing the removal and impoundment of illegally parked vehicles to be enacted by the Borough Council under authority of Section 6109(a)(22) of the Pennsylvania Vehicle Code.[1] All costs incurred in the removal and impoundment of any vehicle shall be paid by the owner of the vehicle.

Enforcement of this Part shall be implemented by the Chief of Police or any law enforcement officer of the Borough.
