Residential-type swimming pools are permitted in any district, provided that there is an existing residence on said lot and the following regulations are complied with:
A. 
Swimming pools shall conform to the requirements of the New York State Building Code.
B. 
Swimming pools shall be located in the rear or side yard.
C. 
No permit shall be issued for a swimming pool unless the applicant can show that the proposed drainage of such pool is adequate and will not interfere with the property of others, with public highways or area drainage facilities. Pools shall not be drained into sanitary sewers or septic systems. Swimming pools shall not be located within 10 feet of any part of a septic system.
D. 
Lights shall be regulated pursuant to Article XIII. Lights shall be turned off when the pool is not in use.
E. 
All electric supply wiring shall be installed in accordance with the National Electrical Code and be inspected by a Town-approved electrical inspection agency prior to the issuance of a certificate of compliance. All electric supply wiring is to be installed underground.
F. 
Building permits shall be required for all swimming pools capable of containing of water depth measuring more than 24 inches deep.

G. 
Pools are to be used in such a manner so as not to create an annoyance or disturbance to neighboring residential properties.
