The cemetery situated north of the City and known as Oak Hill
Cemetery shall be and remain under the control and supervision of
the City Council, as an authorized burial site.

A. The
City Manager and the City Clerk are hereby authorized to sell grave
spaces in Oak Hill Cemetery to be used for the burial of the remains
of bodies of human beings and for no other purpose.
B. The
price to be charged for such grave spaces is two hundred dollars ($200.00)
per space in Sections (A), (B), (C,) and (D) and three hundred dollars
($300.00) per space in Section (F).

A. All
sales of cemetery spaces shall be for cash, to be paid to the City
Clerk, provided, the City Manager may approve the sale of spaces on
a credit basis setting out a regular monthly payment system to provide
for full payment of sale.
B. On
the payment of the full purchase price for said grave space, the same
shall be conveyed by deed, signed by the Mayor and countersigned by
the City Clerk and attached thereto the Seal of the City of Maryville
specifying the owner of the space or spaces described therein by number
as laid down on a plat for the purpose of interment; that such certificate
shall vest in the purchaser, his/her heirs or assigns, the right in
fee simple to such space for the sole purpose of interment of the
remains of human bodies.

A. The
City Manager shall appoint a sexton of said cemetery.
B. Such
sexton shall, upon presentation to him/her of a burial permit issued
by the City Clerk, dig and prepare all graves for the interment of
the dead in said cemetery.
C. The
City Manager shall be charged with the responsibility of the operation
and maintenance of Oak Hill Cemetery.

E. There
will be NO burials on Sunday, and on Memorial Day, Thanksgiving and
Christmas holidays.

A. No
charge shall be made for grave digs for the burial of indigent persons
in Oak Hill Cemetery.
B. For
the purpose of this Section, an "indigent person" shall be defined as a person whose estate is without funds or, in
the case of persons leaving no estate, whose survivors are without
funds, to provide the normal cost of a grave dig in Oak Hill Cemetery,
and which state of indigence has been so certified to the City Clerk.

A. There
is hereby established a fund to be known as the Perpetual Care Cemetery
Fund and the income therefrom shall be expended for the preservation,
care, upkeep and adornment of Oak Hill Cemetery and for no other purpose
whatsoever. The principal of such Perpetual Care Cemetery Fund shall
not be encroached upon for any purpose whatsoever, and no money shall
be transferred out of such Perpetual Care Cemetery Fund except for
the purpose of being invested as herein provided.
B. From
the sale of each grave space, one hundred percent (100%) of this payment
shall be deposited to the Perpetual Care Cemetery Fund.

A. It
shall be unlawful for any person maliciously to remove the earth from
any grave, vault or lot, or maliciously remove, injure, break, deface
or damage any monument, slab, tombstone, paling, wall or other fixture
belonging to any grave, lot or vault in the Oak Hill Cemetery.
B. It
shall be unlawful for any person to maliciously break, cut, damage
or remove any fence or part thereof, or any tree, shrub, flower, ornament
or decoration or any part thereof standing or growing in or around
any grave, vault or lot or on or near the walks, aisles, public grounds
or at any other place in or around said cemetery.
C. The City of Maryville shall in no way be held responsible for damage
done to any tombstones, plant or other fixtures placed on or around
grave sites in Oak Hill Cemetery.

A. Proprietors
shall not allow interments to be made in their lots for a remuneration.
B. No
purchaser of any lot or part of a lot in the City Cemetery shall set
or transfer the same or any part thereof to any private party.
C. The
City may, at their option pay to every such lot owner who desires
to dispose of a purchased lot or to his/her heirs, an amount equal
to the sum originally paid therefor to the City, provided that the
remains of no person shall at the time be or remain interred in such
lot and upon presentation of a duly acknowledged deed. In such purchase,
the City Manager shall act for the City and pay for such lot out of
the Cemetery Fund. A correct abstract of all sales of lots and of
all such transfers shall be kept in the office of the City Clerk.

The southeast quarter of Oak Hill Cemetery, known as the "Potter's
Field", is hereby set apart and declared to be the place for the burial
of the paupers of the City; and for the burial of any persons in such
place there shall be no charges made by the City, either for lots
or otherwise.
