There is hereby created the Department of Public Safety for
the City. This Department shall consist of the Director of Public
Safety and such officers, employees and reserve or volunteer personnel
as may be provided for by the City Council.

It shall be the function of the Department of Public Safety
to preserve order, enforce all ordinances and laws in the City, preserve
the peace, mitigate the results, render aid in the case of disaster
or accident, and prevent and extinguish accidental or destructive
fires.

A. There
is hereby created the office of Director of Public Safety, who shall
be appointed by the City Manager for an indefinite term. The Director
of Public Safety shall be the head of that Department, and all officers,
employees and reserve or volunteer personnel assigned to that department
shall perform their duties subject to his/her supervision. The Director
of Public Safety shall have all the powers and duties assigned by
law or ordinance to the Chief of the Fire Department and the Chief
of the Police Department, and shall perform such functions and duties
as may be prescribed by the Council, City Manager, City ordinances
and State law. It shall be the duty of the Director of Public Safety
and he/she shall:
1. Recommend to the City Manager the employment of persons to fill positions
within the Department.
2. Have the control, subject to the order and directive of the City
Manager, of all fire apparatus belonging to the City.
3. Keep or cause to be kept a record of all fires and training drills
and the attendance of the members of the Department thereat, and file,
with the City Manager a full report of such records and attendance.
4. Keep such records and make such reports concerning police matters
and the activities of his/her Department as may be required by State
law, City ordinance, the City Council or the City Manager.
5. Have the custody of all lost, abandoned or stolen property recovered
in the City.

The Director of Public Safety may make or prescribe such rules
and regulations for the conduct of his/her Department as shall be
in accordance with City personnel rules and regulations. When approved
by the City Manager, such rules shall be binding on the members of
such Department. The rules and regulations may cover the conduct of
the members, uniforms and equipment to be worn or carried, hours of
service, the manner of performance of duties, and other matters necessary
or desirable for the better efficiency of the Department.

Officers, employees, and reserve or volunteer personnel of the
Department of Public Safety shall be appointed in the manner provided
by City personnel rules and regulations. Each officer of the Department
shall be a conservator of the peace and shall have all the responsibility,
authority and liability prescribed by State law or ordinance of the
City.

The Director of Public Safety shall provide each Law Enforcement
Officer with written notice of their duty to cooperate with Federal
and State agencies and officials on matters pertaining to enforcement
of State and Federal laws governing immigration.
