A. In
order to establish the minimum regulations governing the conditions
and maintenance of all property, buildings and structures, to provide
the standards for supplied utilities and facilities and other physical
things and conditions essential to ensure that structures are safe,
sanitary and fit for occupation and use, and to provide for the condemnation
of buildings and structures unfit for human occupancy and use and
the demolition of such structures, except for such portions as are
herein modified, added, deleted or amended within this Chapter, the
International Fuel Gas Code, 2018 Edition, is hereby adopted and shall
be incorporated as if fully set forth herein and shall be hereafter
known as the Fuel Gas Code of the City of Maryville, Missouri, including
the following Appendices:
1. Appendix A — Sizing and Capacities of Gas Piping (IFGS);
2. Appendix B — Sizing of Venting Systems Serving Appliances Equipped
with Draft Hoods, Category 1 Appliances and Appliances Listed for
Use and Type B Vents (IFGS);
3. Appendix C — Exit Terminals of Mechanical Draft and Direct-Vent
Venting Systems (IFGS);
4. Appendix D — Recommended Procedure for Safety Inspection of
an Existing Appliance Installation (IFGS).

A. The
International Fuel Gas Code, 2018 Edition, as adopted as the Fuel
Gas Code of the City of Maryville, is hereby subject to the following
insertions:
1. Section 101.1. The term "City of Maryville" shall be inserted.
2. Wherever a reference is made to "jurisdiction" within the International
Fuel Gas Code, 2018 Edition, it shall be understood to mean the City
of Maryville, Missouri.

Section 106.6.2: Fee Schedule and Section 106.6.3: Fee Refunds, of the International Fuel and Gas Code, 2018 Edition, are deleted in their entirety and in lieu thereof Section
500.090, Building Permit Fees, of the Municipal Code of the City of Maryville is hereby adopted by reference, as if set forth fully herein, as the fee schedule for the Fuel Gas Code of the City of Maryville, Missouri.

Section 109: Means of Appeal, of the International Fuel Gas Code, 2018 Edition, is deleted in its entirety. Any person aggrieved by a decision or action of the Code Enforcement Officer or other designee of the Department of Public Works under this Chapter may appeal such decision or action to the Board of Code Appeals. Such appeal shall be in accordance with the provisions of Sections
530.070,
530.080,
530.090 and
530.110 of the Municipal Code of the City of Maryville and with Chapter
110 of the Municipal Code of the City of Maryville, all of which are adopted herein by reference as if set forth fully herein.

Section 108.5 of the International Fuel and Gas Code, 2018 Edition,
is retained except that any reference to penalty contained therein
is deleted, and the Section shall be enforced in accordance with any
penalty available under civil law, including injunction, and/or the
penalty provisions of this Chapter.

Section 108.4: Violation penalties, of the International Fuel
Gas Code, 2018 Edition, is deleted in its entirety. Any person violating
any of the provisions of this Chapter or any portion of the Code adopted
in this Chapter shall be deemed guilty of an ordinance violation and
upon conviction thereof shall be fined in an amount not exceeding
five hundred dollars ($500.00) or be imprisoned in the City or County
Jail for a period of not exceeding ninety (90) days, or both such
fine and imprisonment. Each day such violation is committed or permitted
to continue shall constitute a separate offense and shall be punishable
as such hereunder.
