[Adopted 6-3-1986 (Ch. 88, Part 2, of the 1976 Code)]
As used in this Part 3, the following terms shall have the meanings indicated:
ALTERATION
The repair, modification or replacement of any component of an on-site sewage disposal system.
ON-SITE SEWAGE DISPOSAL SYSTEM
The septic tank, cesspool, sewage holding tank, marine pump-out holding tank or any other device utilized for the holding or discharge into the ground of untreated sewage.
OWNER
A natural person, corporation, State of New York or any authority or subdivision of the state, the United States of America or any department or agency thereof and any renter, tenant or lessee of real property.
SCAVENGER WASTE
A. 
Only sanitary sewage and normal domestic wastes shall be discharged into the scavenger waste plant. The following waste shall not be discharged into the plant.
B. 
Excluded waste:
(1) 
Industrial waste.
(2) 
Automobile oil and other petroleum products.
(3) 
Drainage from basement floors, footings or roofs.
(4) 
Toxic or hazardous substances and chemicals, including but not limited to pesticides, acids, paints, paint thinner, herbicides, solvents, photographic chemicals, water-softening agents and duck blood.
(5) 
Cesspool cleaning and drain-opening products which are prohibited by Article 39 of the New York Conservation Law, or Suffolk County Local Law No. 12-1980.[1]
SCAVENGER WASTE CARTER
A person, firm or corporation engaged in the business of the hauling and carting of scavenger waste.
SCAVENGER WASTE PLANT
The joint Riverhead/Southampton scavenger waste treatment plant located on Riverside Drive in Riverhead.
TOWN
The Town of Riverhead or the Town of Southampton, exclusive of any villages or incorporated villages.

A. 
License required. No person, firm or enterprise shall engage in the removal of scavenger waste from any cesspool or septic tank located within the Township of Riverhead who does not possess a currently valid license issued by the Superintendent of the Town of Riverhead Sewer District.
B. 
Application for carter's license. Any applicant for a license as required by Subsection A above shall file a sworn statement with the Superintendent of the Town of Riverhead Sewer District on the form prescribed, stating the name and address of the applicant and the type, model and capacity (in gallons) of all vehicles to be used, and which shall include the following acknowledgement:
I, being duly sworn, state and depose that I am familiar with the requirements of the Riverhead Town Code, Section (Scavenger Waste), that I will report the address and exact location of all septic tanks and cesspools pumped by me or my business within the Town of Riverhead as required by Section of the Local Law, known as the "Scavenger Waste Law," and that failure to do so will result in the assessment of a civil penalty of $250 for each violation.
C. 
License fee. Prior to issuance of the license required by Subsection A, the Superintendent of the Town of Riverhead Sewer District shall collect an annual fee to be determined by resolution of the Town Board.
D. 
Monthly reports by carters required. Each carter of scavenger waste, licensed pursuant to this Part 3, shall file, on the last Friday of each month, a report with the Superintendent of the scavenger waste plant stating the address and exact location of each cesspool or septic tank pumped during the preceding month on a form to be supplied by the Superintendent of the scavenger waste plant. Failure of any licensed carter to file such report shall result in the imposition of a civil penalty of $250 for each cesspool or septic tank pumped but not reported as required herein.

A. 
Construction and alteration permits required. No person, firm or enterprise shall construct, modify, repair or replace any septic tank or cesspool or any part thereof located within the Town of Riverhead without obtaining a permit, within five business days from the date work commences, from the Town Clerk. Such permit shall state the exact location, address and Tax Map number of the work in the manner and form specified by the Town Clerk.
B. 
Pumping permit.
(1) 
No scavenger waste hauler shall deposit scavenger waste at the scavenger waste plant except in the manner directed by the employer of the plant as follows:
(a) 
Pay first for full load and file a pump-out report with the plant personnel.
(b) 
Supply a sample in the container provided by the plant.
(c) 
Discharge waste without mess. A hose must be used without pressure, other than gravity feed.
(2) 
Any scavenger waste hauler who violates these provisions may be barred from the scavenger waste plant after a hearing before the Superintendent.
C. 
Pump-out report. The pump-out report shall be a written statement signed by the scavenger waste hauler in the form provided by the Superintendent of the scavenger waste plant detailing the following:

(1) 
The street address of the property where the septic system has been pumped.
(2) 
The quantity of material pumped from the system.
(3) 
The day on which the system was pumped.
(4) 
A hand-drawn diagram showing the location of the pumped underground structure with measurements to identify locations, i.e., buildings, streets, poles and roads.
D. 
Civil penalty. Failure of any person, firm or enterprise to obtain such permit shall constitute a violation punishable by a fine of up to $100.
E. 
The fee charged for such construction permit shall be in an amount prescribed by resolution of the Town Board.
A. 
All new construction of septic tanks, cesspools or other on-site systems shall conform to Standards for Sewage and Waste Disposal Systems, as then established by the Suffolk County Department of Health Services.
B. 
All new construction shall be located as prescribed by the Suffolk County Department of Health Services and at a location where pumping can occur without trespassing on lands of another owner unless an express easement for that purpose over another owner's premises exists.
C. 
All septic tanks and cesspools shall be covered in a manner that permits inspection, as provided for herein, without removal of grass, dirt or other similar landscaping.
A. 
Frequency. At the end of five years after registration, or sooner as conditions may require, the system shall be inspected by qualified inspectors employed by the Town Board of the Town of Riverhead.
B. 
Right of entry. As a condition of registration required hereunder, the owner shall give his consent, at the time of applying for and obtaining the permit, to such inspectors employed by the Town to enter on the owner's premises to make the necessary inspections. The hours of inspection are to be from 9:00 a.m. to 5:00 p.m. on Monday through Friday. Five days' written notice is to be given to the owner that an inspection will be made.
C. 
Right to remove grass, topsoil, dirt and other coverings of the system. No civil claim shall lie against the Town for any damages resulting from any inspection as authorized herein.

Board to set fee. The Town Board shall, by resolution, set the fee for the disposing of scavenger waste at the scavenger waste treatment plant.
No scavenger waste removed from any cesspool or septic tank within the Town of Riverhead shall be dumped or disposed at any location within the Town of Riverhead except at the scavenger waste treatment facility. A violation of this section shall be punishable by a fine of $1,000.
