Fences, walls, hedges, and berms may be erected, placed, or
maintained in any yard along or adjacent to a lot line in accordance
with the requirements identified in this section. The owner shall
be responsible for properly locating all property lines before construction
or placement of any fence, wall, hedge or berm.
A. Location and height.
(1)Â
Residential zoning districts.

(a)Â The maximum height of fences or walls within required side and rear
setbacks in a residential zoning district shall not exceed six feet.
(b)Â Fences or walls around pools shall not exceed six feet.
(c)Â The maximum height of a solid fence or wall within a required front
yard or corner side yard setback shall not exceed three feet.
[1]Â Such front yard or corner side yard fences may be increased to a
maximum height of four feet if open, decorative, ornamental fencing
materials that are less than 50% opaque are used.
[2]Â Such corner side yard fences may be increased to a maximum height
of five feet if open, decorative, ornamental fencing materials that
are less than 20% opaque are used.

When located a minimum of 15 feet from a corner side yard property
line, a solid, six-foot-high fence shall be allowed.
(2)Â
Nonresidential zoning districts. The maximum height of a fence
shall not exceed eight feet except in required front or corner side
yard setbacks where the maximum height of a solid fence shall not
exceed three feet.
(3)Â
In the case of grade separation, such as the division of properties
by a retaining wall, fence height shall be determined based on measurement
from the average point between highest and lowest grade.
(4)Â
Fences on through lots shall be permitted provided the following:
(a)Â
There is no driveway access rights to the adjoin street.
(b)Â
A minimum setback of 12 feet from the street side property line
is provided.
(c)Â
An access gate shall be incorporated into street side fence
for maintenance and access purposes.
(d)Â
A minimum clear distance of 80 feet shall be provided from a
street intersection or any property that has driveway access rights
onto that same adjoining street.
(5)Â
All fences, walls, hedges, or berms shall comply with the vision triangle requirements of §Â
500-410.
B. Materials and construction.
(1)Â
Walls and fences shall be constructed of high-quality materials,
such as decorative blocks, brick, stone, treated wood, wrought iron,
chain link and plastic.
(2)Â
No fence shall have sharp or pointed pickets dangerous to life
or limb.
(3)Â
Hedges shall be trimmed or confined to the property on which
they are planted.
(4)Â
No fence or other structure containing barbed wire or other
dangerous material shall be placed on residentially zoned property
or within four feet of any public street, sidewalk, or alley.
(5)Â
Fences shall be constructed so that the structural supporting
elements are located on the inside (facing away from the street).
(6)Â
Every fence shall be maintained free of structural impairment
and major surface defects or shall be corrected or removed at the
owner's expense within 90 days from the date of such damage.
