This chapter shall be known and may be cited as the "Nottawaseppi Huron Band of the Potawatomi Enrollment Code."
The Tribal Council of the Huron Band of the Potawatomi Indians enacts this chapter in order to provide a comprehensive framework to provide fair, consistent and reasonable procedures to all applicants and members for enrollment, disenrollment, and adoption into the Nottawaseppi Huron Band. The criteria and procedures in Articles III and IV of this chapter shall apply to all pending applications and future applications submitted after the date of adoption. The Tribal Council adopts this chapter pursuant to the express grant of authority enumerated in Article III of the Constitution.
If any provision of this chapter or its application to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of this chapter, which can be given effect without invalid provision, or application, and to this end the provisions of this chapter are severable.
The adoption of this chapter repeals any past enrollment ordinances, codes or resolutions previously passed by the NHBP Tribal Council.
Nothing in this chapter, including the repeal of past enrollment ordinances, codes or resolutions, is intended to modify or invalidate enrollment decisions made or approved under the authority of any ordinance, code or resolution prior to the effective date of this chapter; provided that this ratification of prior enrollment decisions shall not preclude any person enrolled under the authority of any prior ordinance, code or resolution from being subject to disenrollment in accordance with Article VII of this chapter.
This chapter is adopted by resolution of the Tribal Council. The legislative history of actions taken in regards to this chapter are as follows:
A. 
Adoption. The Tribal Council adopted this chapter and repealed the 2007 Membership Ordinance by adoption of Resolution No. 01-17-13-17.
B. 
Amendment to Enrollment Code. The Tribal Council amended the 2013 Enrollment Code on September 18, 2014, by adoption of Resolution No. 09-18-14-07.
