For purposes of this chapter, certain terms are defined in this article. The word "shall" is mandatory and not advisory.
APPLICANT
Any person who has filed an application for enrollment in the Nottawaseppi Huron Band of the Potawatomi prior to the final approval or denial of the application as provided in this chapter.
CLEAR AND CONVINCING PROOF
That measure or degree of proof which will produce in the mind of the trier of facts a firm belief or conviction as to facts or allegations sought to be established.
DISENROLLMENT
The involuntary loss of membership in the Nottawaseppi Huron Band of the Potawatomi.
DNA or DEOXYRIBONUCLEIC ACID
The hereditary material in humans and almost all other organisms.
ENROLLMENT COMMITTEE
The membership and enrollment committee described in Article III, Section 2, of the Band's Constitution and created in Article V of this chapter for the purpose of carrying out the responsibilities set forth in this chapter.
ENROLLMENT OFFICE
The functional department within the Tribal Government with administrative responsibility for maintaining the records relating to enrollment. The Enrollment Office may delegate responsibilities to employees of the Enrollment Office in accordance with the organization and policies and procedures established for the Department.
LINEAL DESCENDANT
The biological child, grandchild, great-grandchild, and etc. of a person listed on the Taggart Census Roll of 1904 as described in Article III of the Constitution of the Nottawaseppi Huron Band of the Potawatomi.
RECORDS or ENROLLMENT FILES
Any item or information about or collected from individuals, including, but not limited to, birth certificates, genealogy reports, or other documents that contain the individual's name, or identifying particulars assigned to the individual, such as photographs, which information is collected for the purpose of determining the eligibility for enrollment in the Band of an individual or members of an individual's family.
RELINQUISHMENT
An act by which an enrolled member voluntarily and officially takes him/herself off the membership roll and gives up the right of tribal membership. It is an action that can only be taken by the individual.
