The title of this chapter shall be the "NHBP Indian Preference
in Contracting Code."
The purpose of this chapter is to:
A. Set forth the policy and requirements for application of Indian preference
to bidding and procurement activities of the Nottawaseppi Huron Band
of the Potawatomi ("NHBP" or the "Tribe").
B. Promote the economic welfare and self-sufficiency of the Tribe, its
members and spouses and/or parents of members by providing contracting
opportunities to businesses owned by those persons in connection with
the purchase of goods and services, consistent with the technical
and business needs of the Tribe and its political subdivisions.
C. Set forth the policy and requirements for application of Indian preference
to bidding and procurement activities for business entities owned
by the Nottawaseppi Huron Band of the Potawatomi ("NHBP") or other
federally recognized Indian tribes.
D. Promote business opportunities for enterprises, which are majority-owned
by NHBP and other federally recognized Indian tribes in order to promote
Tribal objectives to generate business income to further government
purposes of diversifying revenue sources and providing employment
opportunities to tribal members.
E. Promote business opportunities for enterprises which employ NHBP
members and other Native Americans.
F. Provide a legal basis to encourage or require compliance with the
policies and requirements of this chapter by other business entities
or contractors operating on or near the Tribe's Reservation.
If any provision of this chapter is found by the Tribal or Federal
Court to be unconstitutional or unlawful, those provision(s) shall
be struck, and the remainder of this chapter shall remain in full
force and effect.
The effective date of this Code is January 16, 2014.
