Any guardian who wishes to resign may apply in writing to the
Tribal Court, setting forth the reasons for the desire to resign.
If a guardian of the estate or a guardian of both the person and of
the estate shall, at the time of the application, exhibit his/her
final account for settlement, and if the Tribal Court is satisfied
that the guardian has fully accounted, the Tribal Court may accept
the resignation of the guardian, but the guardian so discharged and
his/her sureties are still liable for all matters connected with the
guardianship before discharge.
The Tribal Court shall remove as guardian any person who is
found, after hearing, to have negligently managed the affairs of his/her
ward, or has intentionally caused the ward personal or financial harm.
Any person with personal information as to the actions of the guardian
may petition for his/her removal.
Upon the removal, death or resignation of a guardian, the Tribal
Court shall appoint a successor guardian following the same criteria
that would apply to the initial appointment of a guardian.
