The title of this chapter shall be the "NHBP Civil Infractions
Code."
The purpose of this chapter is to:
A. Promote the health, safety and general welfare of the Tribe, its
citizens and visitors to the Tribe's Reservation;
B. Govern the conduct and activities of all persons on the Reservation
of the Nottawaseppi Huron Band of the Potawatomi by prohibiting certain
acts which are offensive to public order and civil society;
C. Provide for a mechanism for tribal regulation of the conduct and
activities of all persons within the territorial jurisdiction of the
Tribe by providing for the imposition of civil fines and penalties
against persons who engage in certain illegal and offensive conduct.
If any provision of this chapter is found to be unconstitutional
or unlawful by the Courts of the Tribe or the federal courts, such
provision(s) shall be struck and the remainder of this chapter shall
continue in full force and effect.
This chapter shall take effect immediately upon its enactment
by resolution of the Tribal Council.
In its interpretation and application, the provisions of this
chapter shall be held to be minimum requirements and shall be liberally
construed in favor of the Tribe and shall not be deemed as a limitation
upon or repeal of any other tribal power or authority.
The Tribe declares that there is no liability on the part of
the Tribe, its agencies, agents or employees for any damages which
may occur as a result of reliance upon or conformity to this chapter.
The Tribe by the adoption of this chapter does not waive its sovereign
immunity in any respect.
