It has been reported by various agencies that synthetic cannabinoids,
synthetic cathinones and synthetic hallucinogens have been linked
to serious physical effects resulting in hospitalization and death
when ingested, inhaled or otherwise introduced into the human body.
These synthetic cannabinoids, synthetic cathinones and synthetic hallucinogens
pose health, safety, and welfare issues to the residents of the City
of Fall River.
As used in this article, the following terms shall have the
meanings ascribed to them below:
CANNABIMIMETIC AGENTS
Unless specifically exempted by law, any material, compound,
mixture or preparation which contains any quantity of cannabimimetic
agents, their salts, isomers, and salts of isomers whenever the existence
of such salts, isomers and salts of isomers is possible within the
specific chemical designation. As used in this article, "cannabimimetic
agents" means:
A.
Any substance that is a cannabinoid receptor type 1 (CB 1 receptor)
as demonstrated by binding studies and functional assays within the
following structural classes:
(1)
2-(3-hydroxycyclohexyl)phenol with substitution at the 5-position
of the penolic ring by alkyl or alkenyl, whether or not substituted
on the cyclohexyl ring to any extent;
(2)
3-(1-naphthoyl)indole or 3-(1-naphthyl)indole by substitution
at the nitrogen atom of the indole ring, whether or not further substituted
on the indole ring to any extent, whether or not substituted on the
naphthoyl or napthtyl ring to any extent;
(3)
3-(1-naphthoyl)pyrrole by substitution at the nitrogen atom
of the pyrrole ring, whether or not further substituted in the indole
ring to any extent, whether or not substituted on the naphthoyl ring
to any extent;
(4)
1-(1-napththylmethyl)indene by substitution of the 3-position
of the indene ring, whether or not further substituted in the indene
ring to any extent, whether or not substituted on the naphthyl ring
to any extent; or
(5)
3-phenylacetylindole or 3-benzoylindole by substitution at the
nitrogen atom of the indole ring, whether or not further substituted
in the indole ring to any extent, whether or not substituted on the
phenyl ring to any extent.
B.
Any substance which includes any one or more of the following

2-(4-Chloro-2,5-dimethoxyphenyl)ethanamine (2C-C);
(4)
2-(4-Iodo-2,5-dimethoxyphenyl)ethanamine (2C-I);
(5)
2-[4-(Ethylthio)-2,5-dimethoxyphenyl]ethanamine (2C-T-2);
(6)
2-[4-(Isopropylthio)-2,5-dimethoxyphenyl]ethanamine (2C-T-4);
(7)
2-(2,5-Dimethoxyphenyl)ethanamine (2C-H);
(8)
2-(2,5-Dimethoxy-4-nitro-phenyl)ethanamine(2C-N); and
(9)
2-(2,5-Dimethoxy-4-(n)-propylphenyl)ethanamine (2C-P).

Beta-keto-N-methylbenzodioxolylpropylamine;
H.
2-(methylamino)-propiophenone; OR alpha-(methylamino) propiophenone;
J.
2-(methylamino)-1-phenylpropan-1-one;
L.
3,4-dimethylmethcathinone;
M.
Alpha-Pyrrolidinopentiophenone;
N.
Beto-Keto-Ethylbenzodioxolybutanamine;
O.
3,4-methylenedioxy-N-ethylcathinone;
P.
4-methyl-alpha-pyrrolidinobutyrophenone;
Q.
Methylenedioxypyrovalerone or [(MDPV) (1-(1,3-Benzodioxol-5-ul)-2-
(1-pyrrolidinyl)-1-pentanone]; and
R.
MDAI; 5, 6-methylenedioxy-2-aminoinadame.
PERSON
An individual, corporation, partnership, wholesaler, retailer,
or any licensed or unlicensed business.
This article shall be enforced by the Fall River Police Department
through any lawful means in law or in equity, including, but not limited
to, enforcement by criminal indictment or complaint pursuant to MGL
c. 40, § 21, or by noncriminal disposition pursuant to MGL
c. 40, § 21D. The fine for violation of this article shall
be $300 for each offense. A separate offense shall be deemed committed
for each sale, offer to sell, gift, or public display for sale.
The Fall River Police Department shall report any violation
from a licensed establishment to the local licensing authorities.
All substances, found in plain view, being used in violation
of this article may be seized and held until final adjudication, whereupon
they will be destroyed by the Fall River Police Department.
