Any person who erects, constructs, alters, repairs, converts,
maintains, or uses any building, structure or land in violation of
this Part 1 shall be subject to the following penalties: imprisonment
for a term of up to 90 days; a fine of up to $2,000 per day, or a
period of community services of up to 90 days. Whenever a fine is
to be imposed in an amount greater than $1,250 for violations of this
Part 1, the owner shall be provided a thirty-day review period during
which the owner shall be afforded the opportunity to cure or abate
the condition and shall be afforded the opportunity for a hearing
before a court of competent jurisdiction for an independent determination
concerning the violation. Subsequent to the expiration of the thirty-day
period, a fine greater than $1,250 may be imposed if the court has
not determined otherwise or, if upon reinspection of the property,
it is determined that the abatement has not been substantially completed.
