As used in this Chapter, the following terms are defined as follows:
MANUFACTURED HOME, DOUBLE-WIDE
Any structure transportable in two (2) or more sections, which when erected on site measures a minimum of twenty-four (24) feet or more in width and designed to be utilized as a dwelling, with permanent foundation and connected to required utilities and includes the plumbing, heating, air-conditioning and electrical systems contained therein.
MANUFACTURED HOME, SINGLE-WIDE
Any structure transportable in one (1) section designed to be utilized as a dwelling, with or without permanent foundation, when connected to required utilities and includes the plumbing, heating, air-conditioning and electrical systems contained therein.
MANUFACTURED HOME PARK
A contiguous parcel of land which has been developed for the placement of three (3) or more manufactured homes and is owned by an individual, a firm, trust, partnership, public or private association or corporation. It must meet all City ordinances, must be properly licensed and permitted to all construction, building and zoning codes.
MODULAR HOME
A structure transportable in two (2) or more sections without a trailer frame or wheels that when erected on site is designed to be used as a dwelling.

A. 
It shall be unlawful for any person to operate a manufactured home subdivision within the limits of the City of Pineville, Missouri, unless such person holds a valid license issued annually by the Code Enforcement Officer in the name of such person for the specific addresses. All applications for license shall be made to the Code Enforcement Officer, who shall issue a license upon compliance, by the applicant with the provisions of all required City of Pineville ordinances and upon approval by a majority of the Board of Aldermen.

Permit Fees. All permit and inspection fees shall be collected before any approval will be granted.
2. 
Inspections. The inspector of the City shall have the power to enter the mobile home park at reasonable times for the purpose of inspection and investigation of conditions relating to the enforcement of this Chapter and all other City codes and ordinances pertaining to mobile home parks.
3. 
Prohibitions. Except as provided in this Chapter, no mobile home, as defined within this Chapter, may be brought into the corporate City limits of Pineville, Missouri, for purposes of being occupied as a dwelling, except in compliance with this Chapter and approval by the Board of Aldermen who are hereby granted the authority to grant a variance of this Chapter upon just cause.
4. 
Exemptions. This Chapter shall not affect, nor shall it be applied to any currently existing mobile home that is currently occupied and connected to utilities or mobile home parks currently located within the City of Pineville, Missouri, subject to the following exceptions:
a. 
No person who currently occupies a mobile home within the City of Pineville, Missouri, not located within a mobile home park shall cause any other mobile home, not currently located within the City of Pineville, Missouri, to be brought within the corporate City limits to be utilized as a dwelling, unless a substantial improvement can be documented before a permit request is requested as defined in this Chapter.
b. 
No mobile or manufactured homes over eight (8) years old from the current date of approval by the City of Pineville's Board of Aldermen will be permitted within the City limits of Pineville.
c. 
All mobile home parks currently located within the corporate limits of the City of Pineville, Missouri, shall be exempt from this Chapter; provided, however, that within a period of time of eight (8) years from the date of the adoption of this Chapter, all such mobile home parks currently in existence shall be in compliance with the terms of HUD standards and regulations shall be bound in all respects thereby.
5. 
Permits. A permit must be purchased prior to home being moved into the City's jurisdiction. All permits and licenses issued hereunder shall be non-transferable.
6. 
Skirting. All double-wide modular and manufactured housing units shall be skirted with concrete masonry blocks. All skirting shall be located on a poured cement footing of a minimum of four (4) inches in depth and ten (10) inches in width and said skirting shall completely enclose the under portion of any manufactured housing unit. All single-wides shall be skirted with block and masonry, metal or vinyl.
7. 
Steps And Porches. All manufactured housing units shall have a rear and front porch, which porch shall be permanently attached to the real estate and the manufactured housing unit. The front porch shall be of a platform deck type unit with a minimum of forty (40) square feet. It shall be constructed of masonry material, wood or metal. All steps at porches shall have handrails.
8. 
Anchors. All manufactured housing units shall be anchored to the real property by at least six (6) anchors.
9. 
Other Provisions. "I" tongues or hitches located on any manufactured housing unit shall be removed or skirted upon the setting or placement of said manufactured housing unit; thereafter, all evidence of tongue or hitch or "I" beam frame must be completely covered from view.
** NO EXEMPTION — ALL MOBILE/MANUFACTURED HOMES SHALL MEET ALL CITY ELECTRICAL AND SAFETY CODES. **
10. 
Penalties. Any person, firm or corporation who violates any provision of this Chapter shall, upon conviction, be punished by a fine of not less than fifty dollars ($50.00) and not more than five hundred dollars ($500.00) for each day in which the violation occurs and, in addition, may be sentenced to a period of time in the County Jail of not less than one (1) day nor more than ninety (90) days for each day that the violation occurs or continues to occur. The process and procedures for notification of violations and the means of appeal shall be performed as outlined in Chapter 1 of the International Property Maintenance Code, 2003 Edition.

All such units must plainly bear the (HUD) seal and have the approval of the City Planning and Zoning Commission and the City of Pineville Board of Aldermen.

Single-Wide Manufactured Homes. Single-wide manufactured homes will be permitted within Pineville's jurisdiction. All units shall meet all (HUD) Department of Housing and Urban Development codes and standards. All such units must plainly bear the (HUD) seal and have the approval of the City Planning and Zoning Commission and the City of Pineville Board of Aldermen.
C. 
Modular Homes.
1. 
A modular home shall not exceed three (3) stories in height or (45) feet and the modular unit must be set on a permanent foundation and not subject to removal. It must be so designated by the manufacturer as a modular unit and meet all construction codes and requirements as a modular home of its year and model.
2. 
The placement of a modular home may be permitted at all locations within the City of Pineville.
