The Borough of Palmyra hereby signifies its intention and desire
to join the Greater Lebanon Refuse Authority.[1],[2]

Editor's Note: The preamble to Ordinance 434 stated that
the Townships of Annville, West Cornwall, South Lebanon, North Lebanon,
North Cornwall, Swatara and South Annville, and the Boroughs of Cleona
and Jonestown, had formed the Greater Lebanon Refuse Authority under
provisions of the Municipality Authorities Act of 1945 (May 2, P.
L. 382); that each municipality had paid their assessment fee of $0.50
per capita at the time of incorporation; that thereafter as the Boroughs
of Cornwall, Mt. Gretna, Myerstown and Richland, the City of Lebanon,
and the Townships of Bethel, Jackson, North Annville, Heidelberg,
Millcreek and West Lebanon joined the authority, they paid a corresponding
assessment fee plus interest from January 1, 1960; that each municipality
was represented by one member on the Authority's Board; that
Council deemed it necessary to join the Authority. Section 2 of the
ordinance directed the President and Secretary to execute an application
for joining the Authority and file it with the Secretary of the Commonwealth;
Section 3 directed the Secretary to publish the ordinance and notice
of the proposed filing of the application as required by law; Section
4 set forth the name and address of the first Borough representative
on the Board of the Authority; Section 6 repealed all inconsistent
ordinances and parts of ordinances.

The Council of the Borough of Palmyra signifies the intention
and desire to organize an Authority under the Pennsylvania Municipality
Authorities Act, 53 Pa.C.S.A. § 5601 et seq., as amended
and supplemented (the "Act"), for the purposes of exercising any and
all powers conferred by the Act.
The President of Council and the Secretary, respectively, of
this Borough are authorized and directed to execute, in behalf of
this Borough, Articles of Incorporation for said Authority, in substantially
the following form:

In compliance with requirements of the Municipality Authorities
Act, 53 Pa.C.S.A. § 5601 et seq., and pursuant to ordinance
duly enacted by the municipal authority of the Borough of Palmyra,
Lebanon County, Pennsylvania, expressing the intention and desire
of the municipal authority of said municipality to organize an Authority,
jointly, under provisions of said Municipality Authorities Act, said
municipality certifies:

The name of the Authority is "Palmyra Borough Municipal Authority."

The Authority is formed under said Municipality Authorities
Act, as amended and supplemented.

No other Authority has been organized under provisions of the
Municipality Authorities Act, 53 Pa.C.S.A. § 5601 et seq.,
or under the Act of Assembly, approved May 2, 1945, P.L. 382, as amended
and supplemented, known as the "Municipality Authorities Act of 1945"
or under provisions of the Act of Assembly, approved June 28, 1935,
P.L. 463, as amended and supplemented, and is in existence in or for
the incorporating municipality, except that:

under the provisions of said Municipality Authorities Act of 1945,
as amended and supplemented, which was dissolved in 1996.

The President of Council and the Secretary, respectively, of
this Borough further are directed to cause notice of the substance
of this article, including the substance of the foregoing Articles
of Incorporation, and of the proposed filing of such Articles of Incorporation
to be published as required by the Act.
President of Council and the Secretary, respectively, of this
Borough further are directed to cause such Articles of Incorporation,
together with the necessary proofs of publication, to be filed with
the Secretary of the Commonwealth of Pennsylvania, and to do all other
acts and things necessary or appropriate to effect the incorporation
of such Authority, including payment of any filing fees required in
connection therewith.
The Board of the Authority shall consist of five members, all
of whom are appointed by Borough Council of the Borough of Palmyra.
The enactment of this article is deemed necessary for the benefit
and preservation of the public health, peace, comfort and general
welfare of and will increase the prosperity of the citizens of this
Borough.
