Editor's Note: Section 3 of this ordinance directed the proper Borough officers to cause a notice of this ordinance to be published one time in a newspaper published and in general circulation in the county, as directed by the Act of 1945, P.L. 382, the notice to set forth briefly the substance of the proposed Articles of Incorporation and to refer to the provisions of the Act. Section 4 directed specified officers of the Borough, in conjunction with their counterparts in the Borough of Wyomissing, to file the Articles of Incorporation together with necessary proof of publication with the Secretary of the Commonwealth, and to do all things necessary to effect the incorporation. Section 5 repealed all inconsistent ordinances and parts of ordinances.

The Burgess, President of the Borough Council, and the Secretary are hereby authorized and directed to execute, on behalf of the Borough of West Reading, Articles of Incorporation for said Joint Authority in substantially the following form:

In compliance with the requirements of the Act of May 2, 1945, P.L. 382, known as Municipality Authorities Act of 1945, the Borough of Wyomissing and the Borough of West Reading, both in Berks County, Pennsylvania, desiring to incorporate a joint authority thereunder, do hereby certify: | |
1. | The name of the Joint Authority is "The Joint Municipal Authority of Wyomissing Valley, Berks County." |
2. | Said Joint Authority is formed by the Borough of Wyomissing and the Borough of West Reading under the provisions of the Act of May 2, 1945, P.L. 382. |
3. | No other authority organized under this Act, or under the Act approved the 28th day of June, 1935 (P.L. 463) is in existence in or for the incorporating municipalities. |
4. | The names of the incorporating municipalities are the Borough of Wyomissing and the Borough of West Reading. |
5. | The names and addresses of their municipal authorities are as follows: . . . .[1] |
6. | The names, addresses and terms of office of the first members of the Board of said Joint Authority to be formed hereby are as follows: . . . .[2] |
7. | The ordinances authorizing the creation of said Joint Authority, certified from the records of the Boroughs of West Reading and Wyomissing, together with advertisement of notice of filing these Articles of Incorporation, are each submitted herewith. . . .[3] |
8. | The term of existence of said Joint Municipal Authority of Wyomissing Valley, Berks County, shall be for a period ending on July 10, 2039.[4] |

Editor's Note: The Articles of Incorporation of the Joint Authority were amended as set forth in the Joint Authority's Resolution in order to permit an increase in its term of existence to a period ending on July 10, 2039. Said amendment is authorized and permitted by the Authorities Act. The Council of the Borough of West Reading, as one of the governing authorities of the municipalities composing the Joint Authority, authorized and approved the Amendment to the Articles of Incorporation of the Joint Authority by enactment of Ordinance 719, dated April 17, 1990, which amendment added this Paragraph 8 to the Articles of Incorporation of the Joint Authority. The Council of the Borough of West Reading, in said Ordinance 719, also approved the undertaking by the Joint Authority to undertake a project for the addition to and improvement of its sewer system facilities.

The salaries of the members of The Joint Municipal Authority of Wyomissing Valley shall be as follows:
A.
The sum of $20 to each member of the Board of The Joint Municipal Authority of Wyomissing Valley for each meeting of the Board attended by each member; providing, however, that no member of the Board of the Authority shall receive for attendance at such meetings a sum which shall exceed $400 per annum.[1]

Editor's Note: The preamble to Ord. No. 437 stated that the Borough of West Reading was one of the governing bodies of this Authority, which was created by the Boroughs of West Reading and Wyomissing; that the Municipality Authorities Act of 1945, as amended, provides that members of the Board of an Authority are to receive such salaries as may be determined by the governing bodies of municipalities creating the Authority; that pursuant to resolutions duly enacted by each of the two Boroughs, the members of the Board of the Joint Authority presently receive $10 for each meeting attended, with the limitation that no member of the Board receive compensation in excess of $200 a year; and that because of increasing duties imposed upon the Board members, it was advisable and proper that their salaries be increased, subject, however, to the provision in the Municipality Authorities Act that no such salary may be increased during the term for which the member receiving the salary was appointed. This ordinance also provided that it was not to apply to any present member of the Board during the term for which he presently held office, and also repealed any inconsistent resolution.
