GENERAL REFERENCES

A. 
Effect. The provisions of this section shall apply to all officers and members of boards and commissions of the City, regardless of the time of creation of the office or selection of the officer, unless otherwise specifically provided by ordinance or resolution of the Common Council.
B. 
Oath of office. Every official of the City shall, before entering upon his duties and within 10 days after notice of election or appointment, take the oath of office prescribed by law and file said oath in the office of the Clerk. Any person reelected or reappointed to the same office shall take and file an official oath for each term of service.

C. 
Salaries. All officials of the City shall receive such salaries as may be provided from time to time by the Common Council. No official receiving a salary from the City shall be entitled to retain any portion of any fees collected by him for the performance of his duties as such official in the absence of a specific law or ordinance to that effect. The salary of an elected official shall not be changed during his term.

D. 
Vacancies. Vacancies in elective offices shall be filled by appointment by a majority vote of the Common Council for the remainder of the unexpired term. Vacancies in appointive offices shall be filled in the same manner as the original appointment for the remainder of the unexpired term, unless the term for such office is indefinite.
E. 
Outside employment. No full-time official of the City shall engage in any other remunerative employment within or without the City, provided that the Common Council may approve such outside employment or activity if it finds that it does not interfere or conflict with such official's ability to perform his duties in an effective and unbiased manner. Violation of this provision shall be grounds for removal from office of any such official.
F. 
Appointment and terms. Unless otherwise specified in this Code or by law, all appointed officials shall be appointed at the first regular meeting of the Common Council after the spring election in the even-numbered years, by the Mayor, subject to confirmation by a majority vote of the members of the Council and shall serve for a term of two years or until their successors are appointed. Notwithstanding the foregoing, the term of any appointed official who is employed by the City to carry out the duties of his or her office will automatically terminate if the person's employment by the City terminates.
G. 
Powers. In addition to duties and powers enumerated specifically herein, all officials, boards and commissions shall have any other duties and powers provided by laws or ordinance.[1]

A. 
Mayor. The Mayor shall be elected at the annual election in the even-numbered years and shall hold office for a two-year term commencing on the third Tuesday in April in the year of his election.
B. 
Alderpersons. A total of six Alderpersons shall be elected by and from the residents of the City. Each elected Alderperson shall be an at-large Alderperson representing the entire constituency of the City of Lodi. Each Alderperson shall serve for a term of two years commencing on the third Tuesday of April in the year of his or her election. Alderpersons elected in odd-numbered years as of the effective date of this subsection shall continue to be elected in odd years. Alderpersons elected in even-numbered years as of the effective date of this subsection shall continue to be elected in even years.

C. 
Council President. The Council shall, at its first meeting after the regular election in each year, after organization, elect a President from among its members, who shall have the duties and powers specified in § 62.09(8)(e), Wis. Stats.
A. 
Appointed officials. There shall be the following appointed officials, who shall be appointed by the Mayor subject to confirmation by the Common Council, and who shall have the duties and authority provided by law or other sections of the Code:

(1) 
City Clerk.
(a) 
Appointment. The office of City Clerk shall be filled by appointment made by the Mayor subject to approval by the Common Council. The City Clerk shall hold office for an indefinite term subject to removal by a 2/3 vote of the entire membership of the Common Council.
(b) 
Duties and responsibilities. The City Clerk shall be responsible for the preparation, maintenance and custodianship of the official documents of the City and Lodi Common Council. The City Clerk shall be responsible for the issuance of licenses and permits as required by City ordinance and Wisconsin Statutes. The City Clerk shall be responsible for proper supervision of City election activities as required by City ordinance and Wisconsin Statutes.
(2) 
City Treasurer.
(a) 
Appointment. The office of the City Treasurer shall be filled by appointment made by the Mayor subject to approval by the Common Council. The City Treasurer shall hold office for an indefinite term subject to removal by a 2/3 vote of the entire membership of the Common Council.
(b) 
Duties and responsibilities. The City Treasurer shall be responsible for the collection and disbursement of all City money in accordance with City ordinance and Wisconsin Statutes. The City Treasurer shall be responsible for preparation, maintenance and custodianship of all financial forms, records and reports as required by City ordinance and Wisconsin Statutes.
(3) 
City Attorney.
(a) 
Appointment and term. The office of City Attorney shall be filled by appointment made by the Mayor, subject to approval by the Common Council at the first regular meeting after the spring election in odd-numbered years. The term of the City Attorney shall be for two years, ending at the first regular meeting of the Common Council after the spring election in odd-numbered years beginning in 2017, or until a successor is appointed.

(b) 
Duties and responsibilities. The City Attorney shall provide general legal counsel and representation to the City and prosecute and enforce City ordinances.
(4) 
City Assessor. The Common Council shall, by majority vote, select a corporation or independent contractor, pursuant to contractual agreement for services, with the corporation or independent contractor designating an individual within that company as City Assessor.
(5) 
City Engineer. The Common Council shall, by majority vote, select a corporation or independent contractor, pursuant to contractual agreement for services, with the corporation or independent contractor designating an individual within that company as City Engineer.
(6) 
City Zoning Administrator. The Common Council shall, by majority vote, select a provider company, pursuant to contractual agreement for services, with the Mayor designating an individual within that company as City Zoning Administrator.
(7) 
Director of Emergency Management.

(a) 
The Director of Emergency Management shall be appointed by the Mayor, subject to confirmation by the Common Council, and shall receive such salary as may be authorized by the Common Council.
(b) 
The Director of Emergency Management shall be the executive head of the City Emergency Government Organization and shall have the direct responsibility for the organization, administration and operation of such organization, subject to the direction and control of the Mayor and Common Council. In addition to such powers and responsibilities as may be imposed on him/her by the Common Council, he/she shall:

Coordinate all activities for emergency government within the City;
[2] 
Act as liaison and cooperate with emergency government agencies and organizations of other political subdivisions and of the state and federal governments;
[3] 
Participate in county and state emergency government activities upon request;
[4] 
Prepare a comprehensive general plan for the emergency government of the City and present such plan to the Common Council for approval; and
[5] 
Upon the declaration of an emergency, issue all necessary proclamations as to the existence of such state of emergency and such disaster warnings or alerts as are required by the emergency government plan.
(8) 
City Administrator.

(a) 
Appointment. The City Administrator shall be appointed by the Common Council on the basis of merit with due regard to training, experience, administrative ability and general fitness for the office. The City Administrator shall serve at the pleasure of the Common Council and shall hold office for an indefinite term subject to removal at any time by a majority vote of the Common Council. The City Administrator shall serve according to the terms of the employment contract signed by the Administrator and approved by the Common Council prior to the start of employment. Approval of the contract for the employment of the City Administrator shall constitute approval of appointment. This section, however, shall not preclude the Common Council from establishing other employment terms and conditions consistent with the provisions of this division and the employment contract. The office of City Administrator may be eliminated at any time by majority vote of the Common Council.
(b) 
Duties.
[1] 
Be responsible for the overall planning and direction of the activities and services of the municipality.
[2] 
Subject to the limitations defined in resolutions and ordinances of the City of Lodi and Wisconsin Statutes, shall be the chief administrative officer of the City, responsible only to the Mayor and the Council for the proper administration of business affairs of the City, pursuant to the Statutes of the State of Wisconsin, the Ordinances of the City of Lodi, and the resolutions and directives of the Common Council, with power and duties as set forth in this section.
[3] 
Develop, in coordination with department heads, a proposed yearly operating budget for submittal to the Mayor and Common Council.
[4] 
Supervise long and short-range planning for the operation and capital needs of the City.
[5] 
Serve as the City's human resources and personnel manager.
[6] 
May serve as the City's representative at official meetings and represent the City in intergovernmental relations with other government units.
[7] 
General duties for the City Administrator shall be set forth in the job description for the position as prepared by and amended from time to time by the Finance and Human Resources Committee and approved by the Common Council.
[8] 
In the event of a vacancy of the office of City Clerk, the City Administrator also serves as the City Clerk.
A1. 
Deputy officials.

(1) 
The City Clerk may, in writing, filed in the City Clerk's office, appoint a Deputy who shall act under the direction of the City Clerk and in the City Clerk's absence or disability or in the case of vacancy shall perform the City Clerk's duties and shall have the power to administer oaths and affirmations.
(2) 
The City Treasurer may, in writing, filed in the City Clerk's office, appoint a Deputy who shall act under the direction of the City Treasurer and in the City Treasurer's absence or disability or in the case of vacancy shall preform the City Treasurer's duties.
(3) 
The City Attorney may appoint one or more assistants, pursuant to § 62.09 (12)(f), Wis. Stats. to serve at the pleasure of the City Attorney.
B. 
Combining of offices.
(1) 
The offices of Building Inspector and Zoning Administrator may be combined and may be held by the same person.
(2) 
The person holding any such combined office shall have all of the powers and duties specified under the City of Lodi ordinances and law for any of the offices to which such person is appointed regardless of the title he or she may use in any particular order or communication.
C. 
Deputy officials. There shall be such deputies for any of the above officials as the Mayor and Council may from time to time appoint. The deputies shall be appointed in the same manner as other appointed officials and shall act in the absence or unavailability of the official to whom they are deputy. Deputies shall have the same duties and authority as the official to whom they are deputy.
D. 
Assistant City Attorneys. The City Attorney may appoint one or more assistants, pursuant to § 62.09(12)(f), Wis. Stats., who shall receive such compensation from the City as shall be agreed to by the Common Council.

E. 
Weed Commissioner. The Director of Operations shall act as Weed Commissioner, with the duties and powers prescribed in the Wisconsin Statutes and this Code.

F. 
Other statutory officers.
(1) 
The office of Street Commissioner is dispensed with. The duties of Street Commissioner shall be performed by the Director of Operations.

(2) 
The office of Comptroller is dispensed with. The duties of Comptroller shall be performed by the Director of Administration.

(3) 
The office of Constable is dispensed with. The duties thereof shall be performed by the Chief of Police.

(a) 
Appointment. The Chief of Police shall be appointed by the Police Commission.
(b) 
Duties and responsibilities.
[1] 
To exercise general supervision of the Police Department and be responsible for the personnel and general efficiency of the Department.
[2] 
To enforce all ordinances of the City.
[3] 
To have the powers outlined in § 62.09(13), Wis. Stats.
[4] 
To perform other duties prescribed by the state statutes or as lawfully ordered by Common Council.
[5] 
To submit annual, monthly and/or periodic reports as requested by the Mayor and Common Council.
[6] 
The Chief of Police, or designees, are authorized to run a Wisconsin criminal history records check for any lawful purpose, including, but not limited to, on any applicant for a City of Lodi license or employment position to assist in determining whether the applicant possesses the necessary qualifications and for any law enforcement investigative purpose.
(c) 
Responsibility to mayor. The Chief of Police shall be responsible to the Mayor, subject to the policy direction of the Common Council. The Chief of Police shall work closely and coordinate activities with the Director of Administration and the Director of Operations.
(d) 
Removal. The Chief of Police may be removed from office by the Police Commission for cause.[1]

Mayor. The Mayor shall receive a salary of $800 per month.
B. 
Alderpersons. Alderpersons shall receive a salary of $200 per month.
