This chapter is enacted to promote consistency and fairness in the fees to be charged by Pocono Township for licenses and permits. The chapter shall be deemed to apply to any fee or charge imposed by the Township in accordance with the Township's codified ordinances and applicable laws of the United States and Commonwealth of Pennsylvania.
The Board of Commissioners shall adopt and publish a fee schedule covering any matter for which the Township may lawfully impose such charge. The fee schedule shall be adopted by resolution and shall remain in effect until amended or repealed by resolution.
A copy of the current Pocono Township Fee Schedule shall be made available by the Township Secretary to any interested person without charge.
The fee schedule shall be reviewed annually at the first regular meeting of the year by the Board of Commissioners; however, the fee schedule may be amended at any time.
The following standards shall apply to the establishment of fees:
A. 
Imposition of a fee must be authorized by the ordinances of Pocono Township.
B. 
Imposition of a fee shall be authorized directly or by necessary implication by the laws of the Commonwealth of Pennsylvania.
C. 
The fee established shall not be more than is reasonably necessary to cover the Township's cost of administration of the applicable law or ordinance.
The Commissioners may by resolution exempt from payment of all fees or any particular fee a charitable organization, which shall be deemed to be any of the following:
A. 
An organization which is and holds itself out to be a benevolent, educational, philanthropic, humane, patriotic, religious or eleemosynary organization; or
B. 
An organization no part of the net income of which inures to the benefit of any individual and which has received a declaration of current tax exempt status from the government of the United States.
