The storage and display of cigarettes and any other tobacco products by any retail outlet, including but not limited to supermarkets, convenience stores, restaurants, taverns, and any other facility selling cigarettes, in any fashion permitting bodily contact between patrons or customers and the cigarettes and other tobacco products, be and is hereby prohibited.
All such facilities are hereby directed to comply with this article, within 10 days of its effective date, by removing any and all cigarettes and tobacco from locations in their facilities in which direct physical contact between patrons and customers and the cigarettes and tobacco products is feasible.
It is the intent and purpose of the within article to require the sale and distribution of tobacco products directly from the salesperson to the customer and to prohibit the storage and display of cigarettes and other tobacco products in a manner which permits direct acquisition of the product without such salesperson's participation in the sale or distribution.
Any person, partnership, corporation or other entity found to have violated this article shall be subject to the penalties provided in § 1-4 of this Code. Each day on which such unlawful display or storage of cigarettes and tobacco products occurs shall be deemed a separate offense.
