A. 
In order to hear and decide appeals of orders, decisions or determinations made by the Building Official relative to the application and interpretation of all adopted building codes and ordinances, there shall be and is hereby created a Board of Appeals. The Board of Appeals will consist of the City of Reeds Spring Aldermen.
B. 
Chairman. The Mayor shall serve as Chairman and preside over the meetings of the Board of Appeals, and shall be allowed to vote only in case of a tie vote by the voting members of the Board of Appeals.
C. 
Secretary. The City Clerk shall serve as Secretary and shall file detailed records of all proceedings to be archived with the City records.
D. 
Notice Of Meeting. The Board of Appeals shall hold office at its pleasure with the City Clerk posting a notice of all meetings at least twenty-four (24) hours in advance of the meeting. The notice will be posted on the public bulletin board in the lobby of City Hall.
E. 
Open Hearing. All hearings before the Board of Appeals shall be open to the public. The appellant, the appellant's representative, the Code Official and any person whose interests are affected shall be given an opportunity to be heard. A quorum shall consist of not less than two-thirds (⅔) of the Board membership.
F. 
Procedure. The Board of Appeals shall adopt and make available to the public through the Secretary procedures under which a hearing will be conducted. The procedures shall not require compliance with strict rules of evidence, but shall mandate that only relevant information be received.
G. 
Disqualification Of Board Member. A Board member shall not hear an appeal in which he/she has a personal, professional or financial interest.
H. 
Postponed Hearing. When the full Board of Appeals is not present to hear an appeal, either the appellant or the appellant's representative shall have the right to request a postponement of the hearing. Alternate members shall be appointed by a concurring vote of a majority of the total number of Board of Appeals members to hear appeals during the absence or disqualification of a member.
I. 
Board Decision. The Board of Appeals shall modify or reverse the decision of the Code Official only by a concurring vote by a majority of the total number of Board of Appeals members.
J. 
Records And Copies. The decisions of the Board of Appeals shall be recorded by the Secretary and copies shall be furnished to the appellant and the Code Official.
K. 
Administration. The Code Official shall take immediate action in accordance with the decisions of the Board of Appeals.

The Building Inspector for the City is also known as the Code Official and he/she shall be an ex officio member of the Board of Appeals but shall have no vote on any matter before the Board of Appeals.
