A certain document, one (1) copy of which is on file in the office of the City Clerk of the City of Platte City, being marked and designated as the International Residential Code, 2018 Edition, including Appendix Chapters, A, B, C, E, F, H, J, N and T as published by the International Code Council, be and is hereby adopted as the Residential Code of the City of Platte City, in the State of Missouri, for regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, use and occupancy, location, removal and demolition of detached one- and two-family dwellings and townhouses not more than three (3) stories above grade plane in height with a separate means of egress and their accessory structures as herein provided; providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, penalties, conditions and terms of such Residential Code on file in the office of the City of Platte City is hereby referred to, adopted and made a part hereof as if fully set out in this Article, with the additions, insertions, deletions and changes, if any, prescribed in Section 500.170 of this Article.

A. 
The following Sections of the International Residential Code adopted in this Article are hereby revised:
1. 
R101.1 Title. Insert:
These provisions shall be known as the Residential Code for One- and Two-family Dwellings of the [City of Platte City] and shall be cited as such and will be referred to herein as "this code."
2. 
R105.2 Work exempt from permit. Amend:
Exemption from permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Permits shall not be required for the following:
Building:
1.
Retaining walls that are not over four (4) feet in height measured from the bottom of the footing to the top of the wall, unless supporting a surcharge.
2.
Sidewalks and driveways not more than thirty (30) inches above adjacent grade, and not over any basement or story below and are not part of an accessible route and are not located within the City or State rights-of-way.
3.
Painting, papering, tiling, carpeting, cabinets, counter tops and similar finish work.
4.
Prefabricated swimming pools that are less than thirty-six (36) inches deep.
5.
Swings and other playground equipment.
6.
Window awnings supported by an exterior wall which do not project more than fifty-four (54) inches from the exterior wall and do not require additional support.
7.
Reroofing of a residential building or structure which does not cause structural alterations. However, this shall not exempt any person from obtaining a building permit when there shall be structural alterations to a roof.
Electrical:
1.
Listed cord-and-plug connected temporary decorative lighting.
2.
Reinstallation of attachment plug receptacles but not the outlets therefor.
3.
Replacement of branch circuit overcurrent devices of the required capacity in the same location.
4.
Electrical wiring, devices, appliances, apparatus or equipment operating at less than twenty-five (25) volts and not capable of supplying more than fifty (50) watts of energy.
5.
Minor repair work, including the replacement of lamps or the connection of approved portable electrical equipment to approved permanently installed receptacles.
Gas:
1.
Portable heating, cooking or clothes drying appliances.
2.
Replacement of any minor part that does not alter approval of equipment or make such equipment unsafe.
3.
Portable-fuel-cell appliances that are not connected to a fixed piping system and are not interconnected to a power grid.
Mechanical:
1.
Portable heating appliances.
2.
Portable ventilation appliances.
3.
Portable cooling units.
4.
Steam, hot- or chilled-water piping within any heating or cooling equipment regulated by this code.
5.
Replacement of any minor part that does not alter approval of equipment or make such equipment unsafe.
6.
Portable evaporative coolers.
7.
Self-contained refrigeration systems containing 10 pounds (4.54 kg) or less of refrigerant or that are actuated by motors of 1 horsepower (746 W) or less.
8.
Portable-fuel-cell appliances that are not connected to a fixed piping system and are not interconnected to a power grid.
Plumbing:
1.
The stopping of leaks in drains, water, soil, waste or vent pipe; provided, however, that if any concealed trap, drainpipe, water, soil, waste or vent pipe becomes defective and it becomes necessary to remove and replace the same with new material, such work shall be considered as new work and a permit shall be obtained and inspection made as provided in this code.
2.
The clearing of stoppages or the repairing of leaks in pipes, valves or fixtures, and the removal and reinstallation of water closets, provided such repairs do not involve or require the replacement or rearrangement of valves, pipes or fixtures.
3. 
R108.2 Schedule of permit fees. Amend:
On buildings, structures, electrical, gas, mechanical and plumbing systems or alterations requiring a permit, a fee for each permit shall be paid as required, in accordance with the [permit fee schedule] as established by the governing authority in Section 500.510 of the Platte City Municipal Code.
4. 
R108.6 Work commencing before permit issuance. Amend:
Any person who commences any work on a building, structure, electrical, gas, mechanical or plumbing system before obtaining the necessary permits shall be subject to a fee [double] the required permit fee as established in Section 500.510 of the Platte City Municipal Code.

a. Where weathering requires a higher strength concrete or grade of masonry than necessary to satisfy the structural requirements of this code, the frost line depth strength required for weathering shall govern. The weathering column shall be filled in with the weathering index, "negligible," "moderate" or severe" for concrete as determined from Figure R301.2(4). The grade of masonry units shall be determined from ASTM C34, C55, C62, C73, C90, C129, C 45, C216, or C652.
b. Where the frost line depth requires deeper footings than indicated in Figure R403.1(1). The frost line depth strength required for weathering shall govern. The jurisdiction shall fill in the frost line depth column with the minimum depth of footing below finish grade.
c. The jurisdiction shall fill in this part of the table to indicate the need for protection depending on whether there has been a history of local subterranean termite damage.
d. The jurisdiction shall fill in this part of the table with the wind speed from the basic wind speed map [Figure R301.2(5)A]. Wind exposure category shall be determined on a site-specific basis in accordance with Section R301.2.1.4.
e. The outdoor design dry-bulb temperature shall be selected form the columns of 97-1/2 percent values for winter from Appendix D of the lnternational Plumbing Code. Deviations from the Appendix D temperatures shall be permitted to reflect local climates or local weather experience as determined by the Building Official. [Also see Figure R301.2(1).]
f. The jurisdiction shall fill in this part of the table with the seismic design category determined from Section R301.2.2.1.
g. The jurisdiction shall fill in this part of the table with: (a) the date of the jurisdiction's entry into the National Flood Insurance Program (date of adoption of the first code ordinance for management of flood hazard areas), (b) the date(s) of the Flood Insurance Study, and (c) the panel numbers and dates of all currently effective FIRMs and FBFMs or other flood hazard map adopted by the authority having jurisdiction, as amended.
h. In accordance with Sections R905.1.2, R905.4.3.1, R905.5.3.1, R905.6.3.1, R905.7.3.1, and R905.8.3.1, where there has been a history of local damage from the effects of ice damming, the jurisdiction shall fill in this part of the table with "YES." Otherwise, the jurisdiction shall fill in this part of the table with "NO."
i. The jurisdiction shall fill in this part of the table with the 100-year return period air freezing index (BF-days) from Figure R403.3(2) or from the 100-year (99 percent) value on the National Climatic Data Center data table "Air Freezing Index-USA Method (Base 32° F.)."
j. The jurisdiction shall fill in this part of the table with the mean annual temperature from the National Climatic Data Center data table "Air Freezing Index-USA Method (Base 32°F.)".
k. In accordance with Section R301.2.1.5, where there is local historical data documenting structural damage to buildings due to topographic wind speed-up effects, the jurisdiction shall fill in this part of the table with "YES." Otherwise, the jurisdiction shall indicate "NO" in this part of the table.
l. In accordance with Figure R301.2(5)A, where there is local historical data documenting unusual wind conditions, the jurisdiction shall fill in this part of the table with "YES" and identify any specific requirements. Otherwise, the jurisdiction shall indicate "NO" in this part of the table.
m. In accordance with Section R301.2.1.2 the jurisdiction shall indicate the wind-borne debris wind zone(s). Otherwise, the jurisdiction shall indicate "NO" in this part of the table.
n. The jurisdiction shall fill in these sections of the table to establish the design criteria using Table 1a or 1b from ACCA Manual J or establish criteria determined by the jurisdiction.
o. The jurisdiction shall fill in this section of the table using the Ground Snow Loads in Figure R301.2(6).
6. 
R302.2 Townhouses. Amend to read as follows:
Each townhouse shall be considered a separate building and shall be separated by fire-resistance rated wall assemblies meeting the requirements of Section R302.1 for exterior walls.
Exception: A common 2-hour fire resistance rated wall assembly tested in accordance with ASTM E119 or UL 263 is permitted for townhouses if such walls do not contain plumbing or mechanical equipment, ducts or vents in the cavity of the common wall. The wall shall be rated for fire exposure from both sides and shall extend to and be tight against exterior walls and the underside of the roof sheathing. Electrical installations shall be installed in accordance with Chapters 34 through 43. Penetrations of electrical outlet boxes shall be in accordance with Section R302.4.
7. 
R302.2.6 Structural independence. Amended to read as follows:
Each individual townhouse shall be structurally independent.
Exceptions:
1.
Foundations supporting exterior walls or common walls.
2.
Structural roof and wall sheathing from each unit may fasten to the common wall framing.
3.
Non-structural wall and roof coverings.
4.
Flashing at termination of roof covering over common wall.
5
Townhouses separated by a common two-hour fire-resistance-rated wall as provided in Section R302.2.
8. 
R302.6 Dwelling/garage fire separation. Amend to read as follows:
The garage shall be separated as required by not less than 5/8" Type-X gypsum board or equivalent applied to the garage side in accordance with Table R302.6. Openings in garage walls shall comply with Section R302.5 this provision does not apply to garage walls that are perpendicular to the adjacent dwelling unit wall. Garages located less than three (3) feet from a dwelling unit on the same lot shall be protected with not less than 5/8" Type-X gypsum board applied to the interior side of exterior walls that are within this area. Openings in these walls shall be regulated by Section R302.5.2. This provision does not apply to garage walls that are perpendicular to the adjacent dwelling unit wall.

R303.4 Mechanical ventilation. Amend:
Where the air infiltration rate of a dwelling unit is [3] air changes per hour or less where tested with a blower door at a pressure of 0.2-inch w.c (50 Pascals) in accordance with Section N1102.4.1.2, the dwelling unit shall be provided with whole-house mechanical ventilation in accordance with Section M1505.4. Testing shall be performed by an approved third party.
10. 
R312.2.1 Window sills. Deleted in its entirety and replaced with the following language:
Window fall protection: In dwelling units, where the opening of an operable window is located on the second story above grade, the lowest part of the clear opening of the window shall be a minimum of twenty-four (24) inches above the finished floor of the room in which the window is located. Glazing between the floor and twenty-four (24) inches shall be fixed or have openings through which a 4-inch diameter sphere cannot pass.
11. 
R507.9.2(1) and R507.9.2(2). Amend and add the following:
Optional deck attachment installation, 1/2-inch diameter corrosion type lag screws with washers or 1/2-inch diameter corrosion type bolts including nuts and washers, staggered at 12-inches on center to attach the band or ledger joist to the structure shall be permitted. The ends of the band or ledger joist attached to the structure shall have two (2) of the herein described type lags or bolts installed. Alternative engineered structural deck ledger fastener screws meeting the manufacturer's installation instructions to attach band or ledger joist shall be permitted.
12. 
R801.3 Roof drainage. Amend:
All dwellings shall have a controlled method of water disposal from roofs that will collect and discharge all roof drainage to the ground surface not less than [3] feet from foundation walls or to an approved drainage system. Downspout extensions or downspout splash blocks can be used in lieu of an approved drainage system.

Residential garage floor drains are not permitted to be connected to the residential drain system unless provided with an approved oil/grease separator.

P2906.4 Water service pipe. Amend:
Water service pipe shall be a minimum 3/4-inch [Type K copper] or minimum 3/4-inch cross-linked polyethylene [PEX] plastic tubing from the water meter to the structures shut-off and conform to NSF 61 and shall conform to one (1) of the standards listed in Table P2906.4. Water service pipe or tubing, installed underground and outside of the structure, shall have a working pressure rating of not less than 160 psi at 73.4° F. (23° C.). Where the water pressure exceeds 160 psi, piping material shall have a working pressure rating not less than the highest available pressure.
25. 
P3008.1 Backwater valves for (sewer backflow) where required. Amend:
Permit applicants for new home construction or for replacement or repair of sanitary sewer lateral shall be allowed the option of installing a sewage backflow valve. This option shall be provided regardless of the relative elevation between the plumbing fixtures and any part of the public sanitary sewage system. However, applicants electing not to install a sanitary sewage backflow valve shall certify on the permit application the decision not to install such a valve. A backflow valve shall be required for all applicants who refuse or fail to certify on the permit application the decision not to install a sewage backflow valve. Any backflow valve that is installed shall comply with the regulations set forth in the remainder of Section P3008 of this code.
26.

Wiring, conduit and grounding supplying a building or other structure shall not pass through the interior of another building or structure.

Nothing in this Article or in the International Residential Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 500.190 of this Article; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Article.

Any person who shall violate a provision of the code adopted in this Article or shall fail to comply with any of the requirements thereof or who shall erect, construct, alter or repair a building or structure in violation of an approved plan of or directive of the Code Official, or of a permit or certificate issued under the provision of this code, shall be guilty of a misdemeanor, punishable by a fine as follows: for municipal ordinance violations committed within a twelve-month period beginning with the first violation: two hundred dollars ($200.00) for the first municipal ordinance violation, two hundred seventy-five dollars ($275.00) for the second municipal ordinance violation, three hundred fifty dollars ($350.00) for the third municipal ordinance violation, and four hundred fifty dollars ($450.00) for the fourth and any subsequent municipal ordinance violations; Each day that a violation continues after due notice has been served shall be deemed a separate offense.
