The Township is authorized to enter into an intergovernmental cooperation agreement with the Antietam School District, Lower Alsace Township, Mt. Penn Borough, St. Lawrence Borough and the Mt. Penn Borough Municipal Authority to create a regional commission to equip and maintain recreation programs for Township residents.
The conditions of the cooperation agreement are set forth in the intergovernmental cooperation agreement, which is appended hereto as Exhibit A, which is incorporated herein as if set forth in full.[1]

The purpose and objective of the agreement is to create the Recreation Commission of the Antietam Valley (the "Commission") for the purpose of organizing, supervising, administering, maintaining and operating a community recreation and parks program for the benefit of Township residents, as more fully set forth in the attached agreement.[1]

The intergovernmental cooperation agreement shall have an initial term consistent with the agreement.
The Commission shall be funded through the acquisition of public and private grants and private contributions. The Commission may also be funded through voluntary financial or in-kind contributions made by the Township or other members of the Commission.
The organizational structure necessary to implement the agreement includes the creation of a nine-member Commission, with members being appointed by the member agencies. The composition of the Commission is more fully set forth in the agreement.[1] The Commission shall be entitled to establish its own form of organization and appropriate rules and regulations, including bylaws, in accordance with the terms of the agreement.

Real and personal property shall be acquired, licensed, or disposed of in accordance with the terms of the agreement and applicable law.
The parties intend to create a separate legal entity, known as the "Recreation Commission of the Antietam Valley," by adoption of this agreement. Although no employees are contemplated at this time, the Commission may employ such personnel as it may deem necessary. The Commission shall be empowered to enter into contracts for policies of group insurance and employee benefits, including social security, for its employees.
This article authorizes the Township to execute and enter into the intergovernmental cooperation agreement marked as Exhibit A.[1]
