As used in this article, the following terms shall have the meanings indicated:
ACTING MEMBER
An alternate member who has been designated by the Chairperson of the Planning Board as having the power and authority to substitute for, vote and otherwise act in place of a regular member who is absent or otherwise unable to serve.
ALTERNATE MEMBER
An individual appointed by the Town Board as provided herein for a term of one year to serve on the Planning Board when a regular member of that Board is unable to participate on an application or matter before that Board.
PLANNING BOARD
The Planning Board of the Town of Spencer.
REGULAR MEMBER
One of the seven members of the Planning Board who has been appointed by the Town Board for a regular seven-year term or for the remaining unexpired portion of a regular seven-year term.
TOWN BOARD
The Town Board of the Town of Spencer.
A. 
The Town Board shall have the authority to appoint up to two alternate members to the Planning Board. Appointment by the Town Board of an alternate member shall be for a term of one year. At the expiration of such one-year term, the Town Board may reappoint the same alternate member, appoint a new alternate member, or leave the position vacant if it so desires. The Town Board reserves the right to make an appointment on each anniversary of the first appointment, or at any other times that a vacancy shall occur; provided, however, that if a vacancy shall occur otherwise than by expiration of a term, any appointment to fill such vacancy shall be for the unexpired term only.
B. 
The Chairperson of the Planning Board may designate an alternate member as an acting member to substitute for a regular member when such regular member is unable to participate on an application or matter before the Planning Board. When so designated as an acting member, such individual shall possess all of the powers and responsibilities of such regular member. Such designation shall be entered into the minutes of the initial Planning Board meeting at which the appointment is made.
C. 
Provided that all other requirements of this Article III are satisfied, the Planning Board Chairperson's designation of an alternate member to serve as an acting member may be made for a particular meeting or meetings, or for a specified period of time, but in no event beyond:
(1) 
The period of time that the regular member for whom the acting member is serving is unable to participate; or
(2) 
The duration of the alternate member's term of appointment by the Town Board.
D. 
Upon the return of an absent regular member, or the resumption of a regular member's ability to serve, the acting member, unless otherwise directed by the Town Board, shall automatically resume his or her status as an alternate member. Such alternate member shall remain eligible to substitute in the future for the same or any other regular member, subject to the requirements of eligibility set forth in this Article III, including redesignation as an acting member by the Planning Board Chairperson.
E. 
All provisions of state or local law relating to Planning Board member eligibility, vacancy in office, compatibility of office, removal, service on other boards, attendance, compensation, and training/continuing education shall also apply to alternate members.
