The purpose of this chapter is to supplement, in certain respects, the provisions of Title D of the Parks, Recreation and Historic Preservation Law with respect to the operation of snowmobiles in the Town of Spencer, with a view to the protection of the public health, welfare and safety of its inhabitants.

All words, phrases and terms herein shall have the same meanings ascribed to them in § 21.05 of the Parks, Recreation and Historic Preservation Law.
A. 
The operation of snowmobiles along the Town highways of the Town of Spencer, except Dartt's crossroad, is hereby permitted in the following order of use:
(1) 
On the back slope of or on the back side of any snow embankment on any such highway, if passable.
(2) 
If the back slope or back side of snow embankment is impassable, then along the shoulder of such highway.
(3) 
If operation under both Subsections A(1) and (2) is not practicable by reason of impassability, then along the roadway, keeping to the extreme right.
B. 
Like operation of snowmobiles is hereby permitted on such county highways or portions thereof located in the Town of Spencer, as the County Superintendent of Highways may authorize. Such authorizations shall be in writing, filed with the Town Clerk.

In addition to compliance with all other requirements of Title D of the Parks, Recreation and Historic Preservation Law, the operation of snowmobiles in the Town of Spencer shall be subject to the following further requirements:
A. 
No person under the age of 16 years shall operate a snowmobile along any highway, except that a person between the ages of 14 years and 16 years may so operate a snowmobile if accompanied by a person aged 16 or more years.
B. 
Each person operating a snowmobile along any highway shall strictly observe all the vehicular traffic signs and signals and all other rules and regulations applicable to vehicular traffic and shall obey the orders and directions of any law enforcement officer authorized to direct or regulate traffic.
C. 
Except at special events as defined in § 21.05 of the Parks, Recreation and Historic Preservation Law, no person shall operate a snowmobile in any manner which creates loud, unnecessary or unusual noise so as to disturb or interfere with the peace and quiet of other persons or which in any other way constitutes a public nuisance or annoys, injures or endangers the health, safety, comfort and repose of the public. No person shall use a muffler which, by cutout, bypass or any other device, has been rendered ineffective for its purpose.
Failure to comply with any of the provisions of this chapter shall be deemed a violation, and the violator shall be liable to a fine of not more than $250, imprisonment for up to 15 days, or both. In addition, the court may also require the convicted person, as a condition of the sentence in addition to any other penalty, to successfully complete an approved snowmobile safety course.[2]
