§ 326-10 Motor vehicles not to be driven on sidewalks.

No person shall operate any motor vehicle longitudinally upon any sidewalk in the Borough; nor shall any person operate any motor vehicle upon or across any sidewalk except in order to gain access to or egress from a driveway or alley at a location where the curb, if such sidewalk is curbed, shall have been properly cut down for the purpose. Any person who shall violate any provision of this section shall, upon conviction thereof, be sentenced to pay a fine of not more than $50 and costs of prosecution, and, in default of payment of such fine and costs, to imprisonment for not more than 10 days.

§ 326-11 Speed limits established on certain streets.

The speed limit of 25 mph is hereby established on all Borough streets, with the exception of State Routes 209 and 309 and Owl Creek Road in the Borough of Tamaqua.

Any person who shall operate a vehicle or tractor at a speed in excess of that hereby established therefor upon any of the portions of streets herein specified shall, upon conviction thereof, be sentenced to pay a fine of $35 and costs of prosecution and, in default of payment of such fine and costs, to imprisonment for not more than five days.

§ 326-12 Traffic signals at certain locations.

At the following intersections, official traffic signals shall be erected (or if heretofore erected are hereby ratified), and traffic at such intersections shall be directed by such signals:

Any operator of a vehicle or tractor who shall disobey the directions of any traffic signal shall, upon conviction thereof, be sentenced to pay a fine of $5 and costs of prosecution, and, in default of payment of such fine and costs, to imprisonment for not more than five days.

§ 326-13 U-turns prohibited at intersections.

It shall be unlawful for the operator of any vehicle or tractor to make a U-turn at any intersection within the Borough. A reversal of direction at any intersection, regardless of how accomplished, shall be considered a U-turn. Any person who shall violate any provision of this section shall, upon conviction thereof, be sentenced to pay a fine of $10 and costs of prosecution and, in default of payment of such fine and costs, to imprisonment for not more than five days.

Any person who shall operate a vehicle or tractor upon any street or portion thereof hereby established as a one-way street other than in the direction hereby established for vehicular traffic shall, upon conviction thereof, be sentenced to pay a fine of not more than $10 and costs of prosecution, and, in default of payment of such fine and costs, to imprisonment for not more than five days.

§ 326-15 Through highways established.

The following streets or portions thereof are hereby established as through highways, and official stop signs shall be erected (or are hereby confirmed if heretofore erected) on all streets and alleys at their intersections with such through highways (except for such intersections where traffic shall be controlled by official traffic signals). All vehicles and tractors approaching any through highway upon any intersecting street or alley on which an official stop sign shall have been erected shall come to a full stop, within a reasonable distance, before entering upon such through highway:

Any operator of a vehicle or tractor who shall fail to come to a full stop, within a reasonable distance, before entering any such through highway, shall, upon conviction thereof, be sentenced to pay a fine of $5 and costs of prosecution, and, in default of payment of such fine and costs, to imprisonment for not more than three days.

§ 326-16 Stop intersections established.

The following intersections, located in the Borough of Tamaqua, are hereby declared to be stop intersections, and official stop signs shall be erected (or are hereby confirmed if heretofore erected) in such a position as to face traffic approaching the second-named street upon the first-named street, in the direction or directions hereby indicated. All vehicles and tractors approaching any such intersection upon the first-named street, in the direction or directions hereby indicated, in each case, shall come to a full stop, within a reasonable distance, before entering such intersection:

§ 326-17 No turn on red.

[Added 7-19-1977 by Ord. No. 363]

A "NO TURN ON RED" sign shall be erected at certain intersections, prohibiting vehicular traffic facing a steady red signal from entering the intersection to turn on red. This shall apply to traffic at the following intersections.

§ 326-18 Truck traffic restricted to certain streets.

Except local deliveries, no person shall drive any vehicle with a gross weight of 15 tons or greater on:

Editor's Note: This ordinance also redesignated former Subsections C and D as Subsections D and E, respectively.

Nothing in this section shall prohibit any person from driving an emergency vehicle on any of those streets or parts of streets, or from driving on any of those streets or parts of streets a truck or other commercial vehicle making local deliveries to or pickups from premises located along that street or part of a street.

Any person who violates any provision of this section shall be fined $100 and costs.

§ 326-19 Play highways authorized.

[Amended at time of adoption of Code (see Ch. 1, General Provisions, Art. I)]

The Police Department is hereby authorized to designate as a "play highway," whenever it shall deem such action advisable and for whatever period of time directed by it, any portion of any street or alley in the Borough, whereon sledding and coasting shall be permitted. No person shall operate any motor vehicle or tractor upon any play highway at any time when such highway shall be so designated, except in case of emergency, with special permission of the police officer in charge, who shall first clear such highway of all persons using such highway for the purpose for which it was set aside. Any person who shall violate any provision of this section shall, upon conviction thereof, be sentenced to pay a fine of not more than $10 and costs of prosecution, and, in default of payment of such fine and costs, to imprisonment for not more than five days.

§ 326-20 Specific driveways' entrance and exit restrictions.

It shall be unlawful for any vehicle to enter the west side of Pine Street from the market located on the Genetti lot, between Pine and Railroad Streets, in said Borough. This driveway shall be marked by official signs designating it as an "Entrance" to the market from Pine Street only and not as an "Exit" from said market on the Genetti lot.

It shall be unlawful for any vehicle making an exit from the driveway on the premises of the Tamaqua Leased Housing building to turn left onto East Broad Street.

Penalty for violation. Any person who shall violate this section shall, upon conviction thereof, be sentenced to pay a fine of not less than $2 or more than $10 and costs of prosecution, and, in default of payment of such fine and costs, to imprisonment of not more than five days.
