Every person owning any property within the Borough which is
rented, in whole or in part, to one or more persons for residential
purposes shall certify to the Borough Secretary a list of all lessees
and tenants over 18 years of age and their respective addresses on
or before February 1 and June 1 of each year. The forms shall be provided
by the Borough for the purpose of such registration.
Any person owning any property within the Borough which is rented to one or more persons for residential purposes who willfully or negligently fails to submit tenant lists as required by §
253-21, above, shall be liable for, in addition to other penalties herein provided, such sums as would have been billed by the Borough if such tenant list had been provided less any sums actually received from such tenants for the fiscal year for which the list was not provided.

Any person who shall violate or fail, neglect or refuse to comply
with any of the provisions of this article shall, upon being found
liable therefor, pay a fine of not more than $600, plus court costs
and reasonable attorneys' fees incurred by the Borough in the enforcement
proceedings. Such person may also face a license suspension for up
to 30 days. If the penalty is not paid, the Borough shall initiate
a civil action for collection in accordance with the Pennsylvania
Rules of Civil Procedure. Each day a violation exists shall constitute
a separate offense, and each section of this article that is violated
shall also constitute a separate offense. In addition to or in lieu
of enforcement under this section, the Borough may enforce this article
in equity in the Court of Common Pleas of Schuylkill County.
