The purpose of the TO Transitional Overlay District is to provide
nonresidential and mixed-use options within and adjoining neighborhoods
historically comprised of single-family detached dwellings which lie
along and immediately near collectors and arterials where commercial
growth is logically expected. The TO District aims to provide for
an orderly transition of use types within these areas in a manner
that protects the function of single-family detached dwellings while
permitting nonresidential uses. Secondly, the TO District aims to
provide options within lands proximate to the Interstate 79 corridor
where limited access may not permit intensive commercial development
while the location may not logically permit the construction of single-family
detached dwellings.
The uses authorized within and the yard and bulk requirements associated with the base or underlying zoning district shall not be modified within the boundaries of the TO Transitional Overlay District, unless expressly stated within this Part
8. Additional uses, as authorized in Part
27 of this chapter and subject to the provisions of said Part
27 shall be subject to the performance standards and yard and bulk requirements of this chapter.
