There shall be a Police Department, the head of which shall be the Chief of Police.

A.
Within the Department there shall be the police force, which shall consist of such officers and men and women as are authorized pursuant to law. The force shall be organized in three divisions: Patrol, Detective and Central Services. Except as provided for herein, the detailed organization shall be prescribed by the Chief of Police, subject to the approval of the Manager.
B.
The Patrol Division shall be headed by one Captain of Patrol. The Detective Division shall be headed by one Captain of Detectives. The Central Services Division shall be headed by one Captain of Central Services. The Logistics Bureau, part of the Patrol Division shall consist of one Captain. There shall be two shifts covering a twenty-four-hour period, as follows:

C.
Each patrol shift shall be headed by one Lieutenant and shall have two Sergeants assigned and as many Patrolmen as the Chief of Police may from time to time assign.
D.
The Detective Division shall consist of one Captain and three Detectives, one of which shall be a Sergeant or a Lieutenant and the remaining personnel to be police officers.
E.
The Central Services Division shall consist of one Captain and one additional police officer.
The police force, under the direction and supervision of the Chief of Police, shall:
A.
Preserve the public peace, prevent crime, detect and arrest offenders against the penal laws and ordinances effective within the Borough.
B.
Administer and enforce laws and ordinances to regulate, direct and control, and restrict the movement of vehicular and pedestrian traffic and the use of the streets by vehicles and persons generally.
C.
Remove all nuisances in the public streets, parks and other public places.
D.
Inspect and observe all places of public amusement or assemblage and all places of business requiring any state or Borough license or permit, and report thereon to the appropriate department.
E.
Operate a training program to maintain and improve the efficiency of the members of the force.
F.
Perform all other functions as required by general law.

A.
In accordance with N.J.S.A. 40A:14-118, the Borough Manager of the Borough of Lodi shall be deemed the appropriate authority pursuant to that statute and this section. The Borough Manager as the appropriate authority on behalf of the Borough shall be permitted to adopt the rules and regulations of the Lodi Police Department.
B.
In accordance with N.J.S.A. 40A:14-118, the Chief of Police of the Borough of Lodi shall:
(1)
Administer and enforce rules and regulations and special emergency directives for the disposition and discipline of the police force and its officers and personnel;
(2)
Have, exercise, and discharge the functions, powers and duties of the force;
(3)
Prescribe the duties and assignments of all subordinates and other personnel;
(4)
Delegate such of his authority as he may deem necessary for the efficient operation of the force to be exercised under his direction and supervision; and
(5)
Report at least monthly to the Borough Manager of the Borough of Lodi in such form as shall be prescribed by the Borough Manager on the operation of the force during the preceding month, and make such other reports as may be requested by the Borough Manager.
C.
Nothing herein contained shall prevent the appointment by the Borough Manager or by the Mayor and Council of the Borough of Lodi of committees or commissions to conduct investigations of the operation of the police force, and the delegation to such committees or commissions of such powers of inquiry as the Borough Manager or the governing body deems necessary or to conduct such hearings or investigations authorized by law. Nothing herein contained shall prevent the Borough Manager from examining at any time the operations of the police force or the performance of any officer or member thereof. In addition, nothing herein contained shall infringe on or limit the power or duty of the Borough Manager to act to provide for the health, safety or welfare of the Borough in an emergency situation through special emergency directives.
Subject to the approval of the Manager, the Chief of Police shall promulgate and from time to time revise and enforce a manual of police discipline, practices and procedures for the better administration of the work of the Department and for the discipline and efficiency of the police force.
A.
There shall be school crossing guards appointed by the Manager for temporary and seasonal services. Such guards shall serve under the direction and supervision of such officer of the Department as the Chief of Police may designate and shall assist in the protection of the safety of schoolchildren at such school crossings as may be designated pursuant to law.
B.
School crossing guards shall not be authorized to direct traffic unless otherwise permitted by law.
The Manager shall have power to hear and determine any charge or charges filed against a member of the police force pursuant to law and/or any pertinent collective bargaining contract relative thereto.
This article is intended to supersede, amend and modify any and all existing ordinances or regulatory provisions which relate to the Borough Police Department as same may be constituted on the effective date of this amendment to the Administrative Code.

The several police and/or personnel ordinances of the Borough of Lodi are hereby amended in the following manner:

(1)
The position of Chief of Police is hereby established.
(2)
The position of Deputy Chief of Police is hereby established.
(3)
The number of Captains of Police is hereby established to be not more than three.
(4)
The number of Lieutenants of Police is hereby established to be not more than seven.
(5)
The number of Sergeants of Police is hereby established to be not more than 12.
B.
The organizational chart and organizational table of the Police Department of the Borough of Lodi are hereby amended to reflect the provisions and matters contained herein.
C.
The Deputy Chief of Police, as appointed, shall act in all matters in the absence of the Chief of Police and, in such absence, shall have all of the duties and responsibilities otherwise granted to the Chief of Police.
