It is the purpose of the City of Hometown to protect animals from neglect and abuse, to protect residents from annoyance and injury by animals, to assist in providing housing for animals in the custody of the City, to cover the cost of licensing and caring for animals and to establish a program to discourage the excessive multiplication of animals; and also provide for the assessment of penalties for violations and for the enforcement and administration of this chapter.
As used in this chapter, the following terms shall have the meanings indicated:
ANIMAL
Every living creature, domestic or wild, except man.
ANIMAL CONTROL CENTER
A place designated by the Mayor or Director of Public Health and Safety for the housing of animals in the temporary custody of the City.[1]
ANIMAL CONTROL OFFICER
A person performing duties prescribed by the Mayor or Director of Public Health and Safety to effectuate this chapter.[2]
DANGEROUS DOG [3]
(A) 
Any individual dog anywhere other than upon the property of the owner or custodian of the dog and unmuzzled, unleashed, or unattended by its owner or custodian that behaves in a manner that a reasonable person would believe poses a serious and unjustified imminent threat of serious physical injury or death to a person or a companion animal; or
(B) 
A dog that, without justification, bites a person and does not cause serious physical injury.
NEUTERED ANIMAL
A male or female animal treated by a licensed veterinarian to render it incapable of reproduction.
OWNER
Any person who:[4]
(A) 
Has a right of property in an animal;
(B) 
Keeps or harbors an animal; or
(C) 
Has an animal in his care or custody; or
(D) 
Knowingly permits an animal to remain on or about any premises occupied by him.
RUN AT LARGE
To be free of restraint off the premises of the owner.
VICIOUS ANIMAL
Any animal which bites or in any other manner attacks or attempts to attack, except that any animal that bites, attacks or attempts to attack any person entering unlawfully upon its owner's premises, or which is provoked to attack, shall not be deemed a vicious animal.
