It shall be unlawful for any person to maintain and operate
any building or any premises in the Village of New Hartford any mechanical
instrument or device of any kind whereby the sound therefrom is cast
directly upon the public streets and places, and where such device
is maintained and operated for advertising purposes or for the purposes
of attracting the attention of the passing public, or which is so
placed and operated that the sounds carrying therefrom can be heard
to the annoyance or inconvenience of travelers upon any street or
public place or of persons in neighboring premises.
Any person who violates, disobeys, omits, neglects, or refuses
to comply, or who resists the enforcement of, any of the provisions
of this chapter shall be guilty of a misdemeanor and shall be fined
for each offense. Each day that a violation is permitted to exist
shall constitute a separate offense.
A.
Prohibited hours. It shall be unlawful for any person or persons
to make any noise or cause any noise to be made between the hours
of 11:00 p.m. and 6:00 a.m., which noise will cause annoyance or disturbance
to any person or persons unless a permit shall have been obtained
from the Codes Enforcement Officer to commit such noise during the
hours herein specified.
B.
Penalty. Any person or persons violating this section shall be guilty
of the offense of disorderly conduct and be subjected to a fine of
$25 for the first offense and $100 for each and every succeeding offense.
No establishment or place for carrying on any offensive or noisome
trade or business shall be opened, started, established or maintained
in the Village of New Hartford without a permit therefor issued by
the Village of New Hartford or otherwise than in accordance with the
terms of said permit and with the regulations of said Village of New
Hartford.
